13. ٣١ - اذا رفض طلب التسليم الرامي الى تنفيذ عقوبة ما ﻷن الشخص المطلوب تسليمه من مواطني الدولة الطرف متلقية الطلب ، على الطرف متلقي الطلب أن ينظر ، اذا كان قانونه يسمح بذلك وطبقا لمقتضيات هذا القانون ، وبناء على طلب من الطرف الطالب ، في تنفيذ العقوبة المحكوم بها بموجب قانون الطرف الطالب ، أو ما تبقى من هذه العقوبة .
