150. There is no doubt that the expelling State's obligation to protect the property of expelled aliens and to guarantee their access to the said property is established in international law: it is provided for in some international treaties and confirmed by international case law; it is also unanimously supported by the literature and incorporated in the national legislation of many countries.
150 - ولا شك في أن التزام الدولة الطاردة بحماية ممتلكات الأجنبي المطرود وضمان وصوله إلى تلك الممتلكات التزام أقره القانون الدولي: فقد نص عليه بعض المعاهدات الدولية، وأكده الاجتهاد القضائي الدولي؛ وأجمع الفقه على مساندته؛ وأدرجه عدد من التشريعات الوطنية.

220. The next subject examined in the second addendum was the legal consequences of expulsion from the standpoint of the rights of expelled aliens (protection of the property rights and similar interests of expelled aliens, on the one hand, and the right of return in cases of unlawful expulsion, on the other) and of the responsibility of the expelling State.

57. As currently worded, paragraph 1 of draft article E1 (State of destination of expelled aliens) was too restrictive; the primary destinations for an alien being expelled should include not only the State of nationality but also the State of residence.

63. Draft article E1 (State of destination of expelled aliens) should likewise specify that the expulsion of an alien to any State where he or she might be subjected to torture or other cruel, inhuman or degrading treatment was prohibited.

26. With regard to draft article E1 (State of destination of expelled aliens), the discussion had focused on priority to be given to the alien's State of nationality; the alien's choice of State of destination; and whether States other than the State of nationality, such as the State of residence, the passport-issuing State and the State of embarkation, were under any obligation to admit the person being expelled.
