5. In its resolution 49/251 of 20 July 1995, the General Assembly established the mode of financing of the Tribunal.
٥ - في القرار ٤٩/٢٥١ المؤرخ ٢٠ تموز/يوليه ١٩٩٥، حددت الجمعية العامة طريقة تمويل المحكمة.

The Advisory Committee has therefore requested the Secretary-General to submit a report on the requirements of the Tribunal to the General Assembly at its forty-eighth session, based on such decisions as the General Assembly may take at its resumed forty-seventh session on the nature of financing of the Tribunal.

The mode of financing of the Tribunal represents a compromise between those who wish to see it funded on the regular budget scale and those who wish to see it funded on the peace-keeping scale.

2. Decides to authorize the Secretary-General to enter into commitments in the additional amount of seven million and ninety-five thousand dollars for the period from 15 April to 14 July 1995 to allow the Tribunal to continue its activities until 14 July 1995, without prejudice to any decisions that the Assembly may take with regard to the mode of financing of the Tribunal.
٢ - تقرر أن تأذن لﻷمين العام بالدخول في التزامات بمبلغ اضافي قدره سبعة ملايين وخمسة وتسعين ألف دولار للفترة من ١٥ نيسان/أبريل الى ١٤ تموز/يوليه ١٩٩٥ لتمكين المحكمة من مواصلة أنشطتها حتى ١٤ تموز/يوليه ١٩٩٥، وذلك دون اﻹخلال بما قد تتخذه الجمعية من مقررات بشأن طريقة تمويل المحكمة.

23. Ms. GOICOCHEA (Cuba) said that the failure to reach consensus on the mode of financing of the Tribunal was due to the political will and differing positions of Member States.
٢٣ - السيدة جويكوشيا )كوبا(: أشارت الى أن عدم التوصل لتوافق اﻵراء بشأن أسلوب تمويل المحكمة يعود الى الارادة السياسية واختلاف المواقف بين الدول اﻷعضاء.

2. ٢ - تقرر أن تأذن لﻷمين العام بالدخول في التزامات بمبلغ اضافي قدره ٠٠٠ ٠٩٥ ٧ من دولارات الولايات المتحدة للفترة من ١٥ نيسان/أبريل إلى ١٤ تموز/يوليه ١٩٩٥ لتمكين المحكمة من مواصلة أنشطتها حتى ١٤ تموز/يوليه ١٩٩٥، وذلك دون اﻹخلال بما قد تقرره الجمعية العامة بشأن طريقة تمويل المحكمة.

(c) To consider at its resumed forty-eighth session the question of the mode of financing of the Tribunal and the conditions of service and allowances of the members of the International Tribunal.
)ج( أن تنظر في أثناء دورتها المستأنفة الثامنة واﻷربعين في مسألة طريقة تمويل المحكمة وشروط خدمة أعضاء المحكمة الدولية وبدلاتهم.

In paragraph 22 of the revised estimates, and on the basis of the earlier recommendations of the Advisory Committee, the Secretary-General asked the General Assembly to indicate its agreement to The Hague as the seat of the Tribunal, to approve resources for the Tribunal for the biennium 1994-1995, and to determine the mode of financing of the Tribunal and the conditions of service of its members.
ويتضح من الفقرة ٢٢ من التقديرات المنقحة على ضوء التوصيات السابقة للجنة الاستشارية أن من رأي اﻷمين العام أن توافق الجمعية العامة على اتخاذ لاهاي مقرا للمحكمة وعلى تخيص موارد للمحكمة لفترة السنتين ١٩٩٤-١٩٩٥، مع تحديد نظام تمويل المحكمة وشروط خدمة أعضائها.

19. Mr. BARIMANI (Islamic Republic of Iran) endorsed the opinions expressed by the delegations of Pakistan, Mali and Saudi Arabia and, with reference to the question of the mode of financing of the Tribunal, said that it should be funded from the regular budget.
١٩ - السيد باريماني )جمهورية إيران اﻹسلامية(: أيد اﻵراء التي أعربت عنها وفود باكستان ومالي والمملكة العربية السعودية، وقال فيما يتعلق بنظام تمويل المحكمة إنه يتعين تمويلها من الميزانية العادية.

21. In the light of the above observations and recommendations and pending the final decision of the General Assembly on the mode of financing of the Tribunal and the receipt of the report requested in paragraph 12 above, the Advisory Committee recommends that the Secretary-General, at this stage, be authorized to enter into further commitments not exceeding $11 million until 31 December 1994.
١٢ - وفي ضوء الملاحظات والتوصيات الواردة أعلاه ولحين أن تتخذ الجمعية العامة قرارا نهائيا بشأن اسلوب تمويل المحكمة وتلقي التقرير المطلوب في الفقرة ٢١ أعلاه، توصي اللجنة الاستشارية أن يؤذن للأمين العام، في هذه المرحلة، بالدخول في التزامات إضافية لا تتجاوز ١١ مليونا من الدولارات حتى ١٣ كانون اﻷول/ديسمبر ٤٩٩١.

10. Mr. KEATING (New Zealand) said he shared the disappointment which had been expressed by the representative of the Netherlands prior to the adoption of the draft resolution and agreed with the Controller that the current mode of financing of the Tribunal did not constitute prudent financial management.
١٠ - السيد كيتنغ )نيوزيلندا(: قال إنه يشعر بخيبة اﻷمل التي أعرب عنها ممثل هولندا قبيل اعتماد مشروع القرار، وإنه يتفق في الرأي مع المراقب المالي على أن الطريقة الحالية لتمويل المحكمة لا تمثل أسلوبا حصيفا لﻹدارة المالية.
