101. The Working Group considered the draft provisions to enable the use of framework agreements in public procurement under the Model Law presented in document A/CN.9/WG.I/WP.52, noting in particular the scope of the draft provisions and the approach to drafting contained in that document.

Regarding whether to permit the use of framework agreements in the procurement of construction and services, it was noted that the aim of the provisions was appropriate construction and services procurement through framework agreements, but to ensure through the use of specifications and evaluation criteria established in advance that complex construction and services procurement would in practice be excluded.
