Paragraph 1 of that article set forth the basic general rule according to which the status of habitual residents was not affected by a succession of States as such.

The Commission may wish to consider whether it should be complemented by a more specific provision on the right of residence, i.e., the right of habitual residents of the territory over which sovereignty is transferred to a successor State to remain in that State even if they have not acquired its nationality.

On the other hand, paragraph 2 addressed the problem of habitual residents in the specific case where the succession of States was the result of events leading to the displacement of a large part of the population: its purpose was to ensure the effective restoration of their status to habitual residents as protected under paragraph 1.

He had found of special interest the provisions on protecting the unity of a family (article 11), the right of a child to have a nationality (article 12) and the status of habitual residents (article 13), and the provisions that prohibited any form of discrimination (article 14).

With regard to draft article 14 (Status of habitual residents), her delegation, while welcoming the inclusion of a provision intended to mitigate the adverse consequences of population shifts and displacements as a possible result of a succession of States, took the view that the question of the status of habitual residents who were in fact aliens to the States concerned went beyond the scope of the draft articles.
وفي ما يتعلق بمشروع المادة 14 (الوضع القانوني للمقيمين بصفة اعتيادية) رأى وفدها، رغم ترحيبه بإدراج بند يهدف إلى التخفيف من الآثار السلبية للتحولات السكانية وتشرد السكان كنتيجة محتملة لخلافة الدول، أن مسألة الوضع القانونــي للمقيمين بصفـــة اعتياديـــة الذيـــن هم فــي واقع الأمر أجانب بالنسبة إلـى الدول المعنيــة، تتجاوز نطاق مشروع المواد.
