3.5 The author contends that any prosecution in the Islamic Republic of Iran, in the event of his deportation, would be contrary to article 14, paragraph 7, of the Covenant, since he would face the serious prospect of double jeopardy.

9. The source alleges that Mr. al Hussain is being kept in detention without having been formally charged with an offence, without having received any information on the reasons of his deportation from Kuwait to Saudi Arabia or about the proceedings initiated against him.

In light of the information before it, the Committee considers that the author has not sufficiently substantiated that the possible aggravation of his state of health as a result of his deportation would reach the threshold of inhuman treatment within the meaning of article 7 of the Covenant.

5.2 With respect to the author's request for a stay of his deportation until such time as Canada received an extradition request and an assurance that the death penalty would not be carried out, the State party submits that the United States has no obligation to seek extradition of a fugitive nor to give such assurances.

9.7 As to the complainant's allegations that he would be at risk of torture in case of his deportation to Ukraine, the Committee has noted the State party's affirmation that given that the complainant is Belarusian national, he could not be expelled to Ukraine, but only to Belarus.
9-7 وفيما يتعلق بادعاءات صاحب الشكوى أنه يواجه خطر التعرض للتعذيب إذا أُعيد إلى أوكرانيا، تلاحظ اللجنة تأكيد الدولة الطرف أن صاحب الشكوى من مواطني بيلاروس ولا يمكن ترحيله إلى أوكرانيا، بل إلى موطنه بيلاروس فقط.

It cannot therefore be said that a violation of his rights under article 14, paragraphs 1 and 3, of the Covenant would be the necessary and foreseeable consequence of his deportation to the Islamic Republic of Iran.

In case No. 706/1996 (T. v. Australia), the Committee found that the author’s deportation from Australia to Malaysia would not violate the State party’s obligations under article 7 since the information before the Committee did not indicate that it was the foreseeable and necessary consequence of his deportation that he would be treated in violation of article 7.
