17. On the question of the violation of national legislation mentioned by the Government, the Working Group recalls that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
17- وبخصوص مسألة خرق التشريع الوطني التي أثارتها الحكومة، يذكر الفريق العامل أن من واجبه، عملاً بالولاية المنوطة به، أن يضمن تمشي القانون الوطني مع الأحكام الدولية ذات الصلة الواردة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي صدقت عليها الدولة الطرف.

29. On the question of the violation of national legislation mentioned by the Government, the Working Group recalls that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
29- وبخصوص مسألة خرق التشريع الوطني التي أثارتها الحكومة، يُذكِّر الفريق العامل بأن من واجبه، عملاً بالولاية المسندة إليه، أن يضمن تماشي القانون الوطني مع الأحكام الدولية ذات الصلة الواردة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي صدقت عليها الدولة الطرف.

With regard to violations of national legislation, the Working Group reiterates that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
23- وفيما يخص انتهاك التشريع الوطني، يكرر الفريق العامل أن من واجبه، عملاً بالولاية المنوطة به، أن يضمن تمشي القانون الوطني مع الأحكام الدولية ذات الصلة الواردة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي انضمت إليها الدولة الطرف.

(a) To investigate cases of deprivation of liberty imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned;
(أ) التحقق في حالات الحرمان من الحرية المفروض تعسفاً أو بأية طريقة أخرى تتنافى مع المعايير الدولية ذات الصلة والمبيَّنة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية؛

(a) To investigate cases of deprivation of liberty imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned;
(أ) أن يحقق في حالات الحرمان من الحرية المفروض تعسفاً أو بأية طريقة أخرى تتنافى مع المعايير الدولية ذات الصلة والمبيَّنة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية؛

14. The Working Group's mandate provides that it must inquire into cases of arbitrarily imposed detention, provided that the national courts have not reached a final decision concerning conformity with national legislation, and the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned.
14- وتقضي ولاية الفريق بأن يحقق الفريق في حالات الاحتجاز التعسفي، شريطة ألاَّ تكون الهيئات القضائية الوطنية قد اعتمدت قراراً نهائياً بشأن المطابقة مع التشريعات الوطنية والمعايير الدولية ذات الصلة المنصوص عليها في الإعلان العالمي لحقوق الإنسان أو في صكوك قانونية دولية أخرى ذات الصلة وافقت عليها الدول المعنية.

Bearing in mind that, in accordance with Commission resolution 1991/42 of 5 March 1991, the task of the Working Group on Arbitrary Detention is to investigate cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned,
وإذ تضع في اعتبارها أن مهمة الفريق العامل المعني بالاحتجاز التعسفي، وفقاً لقرارها 1991/42 المؤرخ 5 آذار/مارس 1991، هي التحقيق في حالات الاحتجاز المفروض تعسفاً أو بأية طريقة أخرى تتنافى مع المعايير الدولية ذات الصلة والمبينة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية،

Bearing in mind that, in accordance with its resolution 1991/42 of 5 March 1991, the task of the Working Group on Arbitrary Detention is to investigate cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned,

This weakens the legitimacy and the possibilities that the above-mentioned directives be respected and can encourage actions against the freedom and privacy of people involved in the defence of Human Rights or in trade union movements.
وهذا يُضعف شرعية التوجيهين المذكورين أعلاه ويضعف احتمالات احترامهما، وقد يشجع على اتخاذ تدابير مضادة لحرية الضالعين في الدفاع عن حقوق الإنسان أو في حركات نقابية، ومضادة لخصوصيتهم.

18. Decides to extend for a three-year period the mandate of the Working Group, composed of five independent experts, with the task of investigating cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments accepted by the States concerned;
١٨- تقرر أن تمدد لفترة ثلاثة أعوام ولاية الفريق العامل، المكون من خمسة خبراء مستقلين، والمكلف بمهمة التحقيق في حالات الاحتجاز المفروض بطريقة تعسفية أو بطريقة أخرى لا تتفق مع المعايير الدولية المتصلة بالموضوع والواردة في الاعلان العالمي لحقوق الانسان أو في الصكوك القانونية الدولية المتعلقة بذلك والتي قبلتها الدول المعنية؛
