While flag States have primary responsibility for ensuring the effective implementation and enforcement of international rules and standards, port and coastal States play a fundamental and complementary role in the light of the failure of some flag States to exercise effective control over their vessels.

The third segment, on experiences and challenges in maritime safety, highlighted the role of IMO as the competent organization in the adoption of international rules and standards for shipping engaged in international trade, and considered challenges in implementation and enforcement of those rules and standards from the perspectives of flag, port and coastal States.

Given IMO’s global regulatory mandate, which encompasses the development of international rules and standards designed to enhance the safety of life at sea and protect the marine environment from pollution caused by ships, the twin fundamentals of “sustainable development” and “poverty alleviation” have evolved in recent years as parallel concerns to the Organization.

It is recommended that, in accordance with article 94 and the relevant IMO Conventions, flag States take all necessary measures to secure observance of international rules and standards by vessels flying their flag so as to ensure compliance with their international obligations.

As in the case of international instruments pertaining to maritime security, flag States have primary responsibility for ensuring the effective implementation and enforcement of international rules and standards providing for maritime safety (also see paras. 122-124 above).

64. In order to maintain its contribution to global trade, it is essential for international shipping to be regulated for ship safety, including standards of construction and surveying of vessels, labour conditions and proper training of crew (see sect. V.A below), safety and security of shipping routes, and effective implementation and enforcement by States of international rules and standards.
