3. If under article 7 the acceptance of a State that is not a Party to this Statute is required, that State may, by declaration lodged with the Registrar, consent to the exercise of jurisdiction by the Court with respect to the crime. [The accepting State will cooperate with the Court without any delay or exception, in accordance with Part 9 of the Statute.]

1. A State cannot invoke immunity from jurisdiction in a proceeding before a court of another State with regard to a matter or case if it has expressly consented to the exercise of jurisdiction by the court with regard to the matter or case:
1 - لا يجوز لدولة أن تحتج بالحصانة من الولاية القضائية في دعوى مقامة أمام محكمة دولة أخرى في ما يتعلق بأي مسألة أو قضية إذا كانت قد وافقت صراحة على أن تمارس المحكمة ولايتها في ما يتعلق بتلك المسألة أو القضية إما:

Establishment of jurisdiction by the State of nationality is required in such a case to give effect to paragraph 10 of article 16 (extradition), which obliges a State party when it refuses extradition on the ground of nationality to submit the case without undue delay to its competent authorities for the purpose of prosecution (the principle of aut dedere aut judicare).
ومن الضروري تأكيد سريان الولاية القضائية لدولة الجنسية في مثل تلك الحالة بغية إنفاذ مفعول الفقرة 10 من المادة 16 (تسليم المجرمين) التي توجب على الدولة الطرف، عندما ترفض التسليم على أساس الجنسية، أن تحيل القضية دون إبطاء لا مبرر لـه إلى سلطاتها المختصة بقصد الملاحقة (مبدأ إما التسليم أو المحاكمة).

79. In addition, the conduct of the investigation by the relevant authorities of the host State may facilitate the exercise of jurisdiction by States other than the host State as it may enable evidence to be gathered promptly by the host State and transmitted through mutual legal assistance channels to the State undertaking the prosecution.
