4.5 The provisions of article 3 above shall apply if, upon the termination of the period of leave without pay, the participant in the Staff Retirement Plan ceases to be a participant in the Staff Retirement Plan and continues to be a Pension Fund participant and the former participant in the Staff Retirement Plan makes an election in writing to that effect within one year of the termination of the period of leave without pay.

The Board further observed that the amendment had been reformulated to meet the concerns of the Advisory Committee on Administrative and Budgetary Questions by ensuring parity for part-time staff who had been hired on full-time employment status, and later converted to part-time status, and providing that the amendments be formulated to include the same constraints that applied to periods of leave without pay for full-time staff.

4.4 Subject to article 4.1, if a participant in the Staff Retirement Plan becomes a Fund participant during a period of leave without pay from AfDB and, upon the termination or expiration of such period (not exceeding three consecutive years when no contributions are made), ceases to be a Fund participant and resumes contributory service in the Staff Retirement Plan, no benefit becomes payable, but the provisions of article 2 above shall apply.

(c) Salary and wage increments shall be effective on the first day of the pay period in which the service requirements are completed, provided that the period of service may be shortened to meet the requirements of rule 103.9 and that such increments shall not be effective earlier than the first day of the pay period in which a staff member returns to pay status from a period of leave without pay.
)ج( تصبح العلاوات الدورية للمرتبات واﻷجور نافذة اعتبارا من اليوم اﻷول من فترة صرف المرتب التي يكون الموظف قد استوفى فيها مقتضيات الخدمة المطلوبة، على أنه يجوز تقصير مدة الخدمة المطلوبة للوفاء بمقتضيات القاعدة ١٠٣/٩، ولا يكون للموظف الذي يعود إلى الخدمة بعد إجازة بدون مرتب حق في العلاوة الدورية إلا اعتبارا من اليوم اﻷول من فترة صرف المرتب التي يقيد اسمه فيها من جديد في كشف المرتبات.
