In his report the Special Rapporteur had analysed correctly the observations of States on the main issues concerning allocation of loss in case of transboundary harm arising out of hazardous activities and had drawn conclusions in the light of those observations.

Her delegation vigorously supported the work on the legal regime for the allocation of loss in case of transboundary harm arising out of hazardous activities, believing that, following the elaboration of the draft articles on prevention, it was logical to proceed to the question of liability in relation to the same activities.

Part II of the report reviewed sectoral and regional treaties and other instruments (ibid., paras. 47-113), some of which were well established and others not yet in force but instructive as models for allocation of loss in case of transboundary harm.

It may be recalled that in his first report, by way of summation and submissions, the Special Rapporteur identified some broad points, which, if agreed upon, could form the basis for drafting suitable principles governing the legal regime for the allocation of loss in case of transboundary harm arising out of hazardous activities.

With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation commended the Special Rapporteur for his treatment of the allocation of loss in case of transboundary harm arising out of hazardous activities, in particular the principles that the innocent victim should not bear the loss or injury and that the polluter should pay.
32 - واستطرد قائلا إنه فيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أعمال لا يحظرها القانون الدولي، قال إن وفده يثني على المقرر الخاص لمعالجته لمسألة من يتحمل الخسارة في حالة الضرر العابر للحدود الناجم عن أنشطة خطرة، وخصوصا المبدأ القائل بأن الضحية البريئة ينبغي ألا تتحمل الخسارة أو الضرر والمبدأ القائل بأن الملوث ينبغي أن يدفع.

30. Australia welcomed the Commission's resumption of work on the issue of international liability following its consideration of the prevention of transboundary harm from hazardous activities and commended the Special Rapporteur for his first report on the legal regime for the allocation of loss in case of transboundary harm arising from hazardous activities (A/CN.4/531).
30 - وأعربت عن ترحيب استراليا باستئناف لجنة القانون الدولي العمل بشأن مسألة المسؤولية الدولية بعد نظرها في منع الضرر العابر للحدود الناجم عن أنشطة خطرة، وعن ثنائها على المقرر الخاص لتقديمه تقريره الأول بشأن النظام القانوني لتوزيع الخسارة في حالة الضرر العابر للحدود الناجم عن أنشطة خطرة (A/CN.4/531).

10. The report of the Special Rapporteur on allocation of loss in case of transboundary harm arising out of hazardous activities provided an in-depth analysis of the need to protect the interests of innocent victims.
