As no explanation has been given by the State party and no efforts have been made to clarify the fate of Mensud Rizvanović, the authors consider that the State party has violated article 9, read in conjunction with article 2, paragraph 3, of the Covenant.

They consider that the failure by the State party to investigate the torture and inhuman and degrading treatment the victim suffered in detention amounts to a violation of article 10, read in conjunction with article 2, paragraph 3, of the Covenant in respect of Mensud Rizvanović.
وترى صاحبتا البلاغ أن عدم إجراء الدولة الطرف تحقيقاً فيما تعرض له الضحية أثناء الاحتجاز من تعذيب ومعاملة لا إنسانية ومهينة يصل إلى انتهاك المادة 10 مقروءةً بالاقتران مع الفقرة 3 من المادة 2 من العهد، فيما يتصل بحق منسود رزفانوفيتش.

The ceaseless efforts undertaken by the authors to shed light on the fate of Mensud Rizvanović and to access potentially effective remedies have been impeded since his disappearance.
وقد أُعيقت الجهود المستمرة التي بذلتها صاحبتا البلاغ، منذ اختفاء منسود رزفانوفيتش، لكشف مصيره وللوصول إلى سبل انتصاف فعالة ممكنة.

The authors therefore consider that the State party is responsible for an ongoing violation of article 16, read in conjunction with article 2, paragraph 3, of the Covenant in respect of Mensud Rizvanović.

7.1 On 15 September 2011, the authors sent their additional comments, in which they considered that the State party's reply did not provide any new information with regard to the enforced disappearance of Mensud Rizvanović, and that it failed to address a number of the issues that they had raised.
