وردّا على سؤال بشأن تطبيق المادة 10 في سياق الأفعال المجرّمة في البروتوكولات، أشارت غالبية الدول المجيبة إلى أن الهيئات الاعتبارية ستكون مسؤولة عن أي فعل مجرّم بمقتضى التشريعات الوطنية.

C. Replacement of the phrase " illicitly acquired assets " with the phrase " proceeds of offences established in accordance with this Convention "
الاستعاضة عن عبارة " الموجودات المكتسبة بصورة غير مشروعة " بعبارة " عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية "

2. States Parties shall take such additional legislative or other measures as they consider appropriate to prevent means of transport operated by commercial carriers from being used in the commission of offences established under this Protocol.
٢ - على الدول اﻷطراف أن تتخذ ما تراه مناسبا من تدابير تشريعية أو غير تشريعية اضافية لمنع استخدام وسائل النقل التي يشغلها الناقلون التجاريون في ارتكاب الجرائم المبينة في هذا البروتوكول .

2. Each State Party shall adopt legislative or other appropriate measures to prevent, to the extent possible, means of transport operated by commercial carriers from being used in the commission of offences established in accordance with article 5 of this Protocol.
2- يتعين على كل دولة طرف أن تعتمد تدابير تشريعية أو تدابير أخرى مناسبة لكي تمنع، الى أقصى مدى ممكن، استخدام وسائل النقل التي يشغّلها الناقلون التجاريون في ارتكاب الجرائم المقررة وفقا للمادة 5 من هذا البروتوكول.

States Parties shall take such additional legislative or other measures as they consider appropriate to prevent means of transportation operated by commercial carriers from being used in the commission of offences established under article 4 of this Protocol.
يتعين على الدول اﻷطراف أن تتخذ ما تراه مناسبا من تدابير تشريعية أو غير تشريعية اضافية لمنع استخدام وسائل النقل التي يشغّلها الناقلون التجاريون في ارتكاب جرائم مقررة بمقتضى المادة ٤ من هذا البروتوكول.

5. In order to facilitate the recovery of proceeds of offences established in accordance with this Convention, States Parties may cooperate in providing each other with the names of experts who could assist in achieving that objective.
5- تيسيرا لاسترداد عائدات الأفعال المجرمة وفقا لهذه الاتفاقية، يجوز للدول الأطراف أن تتعاون على تزويد بعضها البعض بأسماء الخبراء الذين يمكن أن يساعدوا على تحقيق ذلك الهدف.

1. This Convention shall apply, in accordance with its terms, to the prevention, investigation and prosecution of corruption and to the freezing, seizure, confiscation and return of the proceeds of offences established in accordance with this Convention.
1- تنطبق هذه الاتفاقية، وفقا لأحكامها، على منع الفساد والتحري عنه وملاحقــة مرتكبيه، وعلى تجميد وحجز وارجاع العائدات المتأتية من الأفعال المجرّمة وفقا لهذه الاتفاقية.

(e) Preventing and combating the transfer of proceeds of offences established in accordance with this Convention and recovering such proceeds;
(ﻫ) منع ومكافحة إحالة عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية وارجاع تلك العائدات؛

(f) Detecting and freezing of the transfer of proceeds of offences established in accordance with this Convention;
(و) كشف وتجميد احالة عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية؛

(h) Appropriate and efficient legal and administrative mechanisms and methods for facilitating the return of proceeds of offences established in accordance with this Convention;
(ح) استحداث آليات وأساليب قانونية وإدارية ملائمة وفعّالة لتيسير إرجاع عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية؛

٢ - على الدول اﻷطراف أن تتخذ ما تراه مناسبا من تدابير تشريعية أو غير تشريعية اضافية لمنع استخدام وسائل النقل التي يشغله ناقلون تجاريون في ارتكاب الجرائم المبينة في هذا البروتوكول .

64. The court's jurisdiction should be limited to the most serious crimes, as set forth in article 20 of the draft statute, with the exception of offences established in treaties dealing with terrorism and drug trafficking, which could be handled by national courts, and the crime of aggression.
٤٦ - وأضافت أنه ينبغي أن تكــون ولايــة المحكمة مقتصــرة على أكثــر الجرائـم خطـورة، كما نصت المادة ٠٢ من مشروع النظام اﻷساسي، باستثناء الجرائم المقررة في المعاهدات التي تتناول اﻹرهاب والاتجار في المخدرات، التي يمكن للمحاكم الوطنية أن تفصل فيها، وجريمة العدوان.

1. This Protocol shall apply, except as otherwise stated herein, to the prevention of illicit manufacturing of and trafficking in firearms, their parts and components and ammunition and to the investigation and prosecution of offences established in accordance with article 5 of this Protocol where those offences are transnational in nature and involve an organized criminal group.
1- ينطبق هذا البروتوكول، باستثناء ما يُنص فيه على خلاف ذلك، على منع صنع الأسلحة النارية وأجزائها ومكوناتها والذخيرة والاتجار بها بصورة غير مشروعة؛ وعلى التحري عن الجرائم المقررة وفقا للمادة 5 من هذا البروتوكول وملاحقتها، حيثما تكون تلك الجرائم ذات طابع عبر وطني وتضلع فيها جماعة اجرامية منظمة.

على الدول اﻷطراف أن تتخذ ما تراه مناسبا من تدابير تشريعية أو غير تشريعية اضافية لمنع استخدام وسائل النقل التي يشغّلها الناقلون التجاريون في ارتكاب جرائم مقررة بمقتضى المادة ٤ من هذا البروتوكول .

Article 8 of the 1988 Convention obliges parties to consider the possibility of transferring to one another proceedings for criminal prosecution of offences established in accordance with article 3, paragraph 1, of the Convention in cases where such transfer is considered to be in the interests of the proper administration of justice.
وتلزم المادة 8 من اتفاقية سنة 1988 الأطراف على النظر في إمكانية نقل إجراءات الملاحقة الجنائية من طرف إلى آخر بشأن الجرائم المنصوص عليها في الفقرة 1 من المادة 3 من الاتفاقية في الحالات التي يُرى فيها أن هذا النقل له فائدة في إقامة العدل.

(a) By establishing and maintaining channels of communication between their competent agencies and services to facilitate the secure and rapid exchange of information concerning all aspects of offences established in accordance with article 2 of the Convention;
)أ( عن طريق إنشاء قنوات اتصال فيما بين أجهزتها ودوائرها المختصة، والاحتفاظ بتلك القنوات لتيسير التبادل المأمون والسريع للمعلومات المتعلقة بجميع جوانب الجرائم التي تم تحديدها وفقا للمادة ٢ من الاتفاقية؛

Portuguese law provides for immunity of the holders of certain political and high public offices in the government hierarchy; however, the existence of special procedures ensures that immunities or jurisdictional privileges will not impede the investigation, prosecution and sentencing of offences established in accordance with the Convention.
وينص القانون البرتغالي على حصانة شاغلي وظائف سياسية وعمومية رفيعة معيّنة في التسلسل الهرمي الحكومي؛ ومع ذلك، يضمن وجود إجراءات خاصة أنَّ الحصانات أو المزايا المرتبطة بالولاية القضائية لن تعرقل التحقيق في الجرائم المنصوص عليها في الاتفاقية والملاحقة المتعلقة بها والحكم فيها.
