ولا يجوز أن يكون رئيس الهيئة من مواطني أحد أطراف النزاع، ولا تكون إقامته العادية في إقليم أحد هذين الطرفين أو يعمل لديهما، ولا أن يكون قد تناول القضية بأي صفة أخرى.
