18- في حالة عدم قدرة الطرف المسؤول عن الانتهاك أو عدم رغبته في الوفاء بهذه الالتزامات، يجب على الدولة أن تسعى إلى توفير الجبر للضحايا الذين أصابهم أذى بدني أو أضرار بدنية أو ذهنية جراء هذه الانتهاكات، وللأسر، لا سيما الأشخاص المعالين الذين توفوا أو أُصيبوا بعجز بدني أو ذهني جراء الانتهاك.

١٣١ - تمنع القوانين العقابية منها قانون العقوبات رقم ١١١ لسنة ٩٦٩١ المعدل في مادتيه )٢٣٣ و٣٣٣( وكذلك قانون أصول المحاكمات الجزائية رقم ٣٢ لسنة ١٧٩١ المعدل استخدام الاكراه المادي والمعنوي عند اجراء التحقيق وهذا يشمل الكبار واﻷطفال دون تحديد سن معينة.
