Her delegation's position on the permissibility of reactions to reservations had been stated in previous years: since the provisions of articles 20 and 21 of the Vienna Convention were not applicable in the case of reservations that were contrary to the object and purpose of a treaty, acceptance of or objection to such reservations produced no legal effect.

However, in order to understand the draft guidelines proposed in this report for inclusion in part III of the Guide to Practice, it seems appropriate to recall the context of the issue of the validity of reservations and to briefly review the draft guidelines already adopted by the Commission in 2006 and 2007166 (A), before addressing the related issue of the validity of reactions to reservations (B).

In connection with the topic " Reservations to treaties " , the Commission considered the fourteenth report of the Special Rapporteur (A/CN.4/614 and Add.1) dealing, in particular, with outstanding issues relating to the procedure for the formulation of interpretative declarations, and with the permissibility of reactions to reservations, interpretative declarations and reactions to interpretative declarations.
