Further, it also notes with concern that even children between 11 and 14 may not be subject to the Juvenile Courts Law if they are accused of having committed a crime falling under the jurisdiction of State Security Courts or military courts or if they live in areas under a state of emergency.
وتلاحظ بقلق أيضاً أن الأطفال المتراوحة أعمارهم بين 11 و14 عاماً لا يجوز إخضاعهم لقانون محاكم الأحداث إذا كانوا متهمين بارتكاب جريمة مشمولة باختصاص محاكم أمن الدولة أو المحاكم العسكرية أو إذا كانوا يقطنون في مناطق خاضعة لحالة طوارئ.

On 7 May 2004 the relevant article of the Constitution was repealed and on 16 June 2004, the Code of Penal Procedure was amended so as to abolish the State Security Courts, and the Act on the Establishment of State Security Courts and Rules of Procedure was revoked.
وأُبطِلت، في 7 أيار/مايو 2004، المادة ذات الصلة في الدستور، كما عدِّل قانون الإجراءات الجنائية في 16 حزيران/يونيه 2004 بغية إلغاء محاكم أمن الدولة، وأبطل، أيضاً، القانون الخاص بإنشاء محاكم أمن الدولة وبنظامها الداخلي.

Furthermore, the Government informed the Special Rapporteur of a reform process initiated in Turkey with the aim of improving the standards of democracy and human rights; the envisaged reforms included undertaking the necessary efforts to eradicate the practice of torture, shortening detention periods and reforming the system of State Security Courts (13 December 1995 and 9 and 23 October 1996).

فقد لاحظت اللجنة مع القلق في ما يخص الحالة السائدة في إحدى الدول الأطراف أن الأطفال الذين تتراوح أعمارهم ما بين 11 و14 سنة قد لا يخضعون لقانون محاكمة الأحداث إذا كانوا متهمين بارتكاب جريمة تقع ضمن اختصاص محاكم أمن الدولة أو المحاكم العسكرية أو إذا كانوا يقطنون في مناطق خاضعة لحالة طوارئ(41).

b) The offences specified in paragraphs (b), (c) and (e) of Article 9 of the Law No: 2845 on the Establishment and Trial Procedures of State Security Courts are considered as terrorist offences if they are perpetrated with a view to attaining the terror objectives indicated in forgoing Article 1. "
