8- تقدّم الاتفاقية المتعلقة بالممتلكات الثقافية المسروقة أو المصدّرة بطرق غير مشروعة() مجموعة من الأحكام التي تنطبق على المطالبات المقدمة من الأفراد وضدهم بشأن رد الممتلكات الثقافية وإعادتها، وبذلك أوجدت آلية محدّدة تمنح فرادى المالكين الحق في الاستعانة بمحكمة تقع في دولة طرف أخرى لأغراض رفع الدعاوى القضائية بشأن إعادة الممتلكات الثقافية المسروقة.

The main obligation of States parties under the Convention is to prevent the illicit import of stolen cultural property and to encourage dealers to keep inventories of objects to determine their provenance. It also allows concerned States parties to ask other States parties for help in protecting the affected categories of materials through measures that may include restrictions on imports and exports.

(a) States should consider including in their cooperation agreements on protection against trafficking in cultural property, specific provisions for information exchange, a coordinated follow-up of the flow of cultural objects, whenever feasible and the return or as appropriate, the restitution of stolen cultural property to its rightful owner.
(أ) ينبغي للدول أن تنظر، في إطار اتفاقات التعاون التي تبرمها من أجل الحماية من الاتجار بالممتلكات الثقافية وكذلك بطرائق أخرى، في وضع أحكام محدَّدة تتعلق بتبادل المعلومات؛ وفي تنسيق متابعة تدفق الممتلكات الثقافية، كلما تسنَّى ذلك؛ وإعادة الممتلكات الثقافية المسروقة أو، عند الاقتضاء، ردّها إلى أصحابها الشرعيين.
