15. The Government provides the following information on each of the above-mentioned persons:

The response from the Government does not contain clear and persuasive arguments that the rights of the above-mentioned persons to not be arbitrarily deprived of their liberty or persecuted have been respected according to the international legal guaranties.
ولا يتضمن الرد الوارد من الحكومة أي حجج واضحة ومقنعة بأن حقوق الأشخاص المذكورين أعلاه في عدم حرمانهم تعسفاً من حريتهم أو اضطهادهم كانت موضع الاحترام وفقاً للضمانات القانونية الدولية.

14. In its comments to the Government's observations, the source reiterates that the detention of the above-mentioned persons is unlawful and arbitrary.
14- ويؤكد المصدر مجدداً في تعليقاته على ملاحظات الحكومة أن احتجاز الأشخاص المذكورين أعلاه غير قانوني وتعسفي.

26. Consequent upon the Opinion rendered, the Working Group requests the Government to take the necessary steps to remedy the situation of the above-mentioned persons.
26- وبناء على الرأي المقدم، يطلب الفريق العامل من الحكومة اتخاذ الخطوات الضرورية لتصحيح وضع الأشخاص المذكورين أعلاه.

It is further reported that during their incommunicado detention all of the above-mentioned persons were submitted to acts of torture and bad treatment.
وأفيد كذلك بأن جميع الأشخاص المذكورين أعلاه قد تعرضوا لممارسات التعذيب وسوء المعاملة أثناء فترة احتجازهم في الحبس الانفرادي.

Therefore, the Working Group, in the absence of any response from the Government, considers that the deprivation of liberty of the above-mentioned persons is arbitrary under category III of the categories applicable to the consideration of cases submitted to the Working Group.

11. Under these circumstances, the Working Group considers that neither the source nor the Government has provided it with the information it needs needed to determine whether or not the detention of the above-mentioned persons was arbitrary.
11- وفي ظل هذه الظروف، يرى الفريق العامل أن لا المصدر ولا الحكومة زوّداه بالمعلومات اللازمة لتحديد ما إذا كان احتجاز الأشخاص المذكورين أعلاه تعسفياً أم لا.

By communications dated 2 February and 28 March 1995, the Government informed the Special Rapporteur that investigations had started and measures had been adopted to protect the life and physical integrity of the above-mentioned persons.
٢١- وبرسالتين مؤرختين في ٢ شباط/فبراير و٨٢ آذار/مارس ٥٩٩١، أبلغت الحكومة المقرر الخاص بأن التحقيقات قد بدأت وأن إجراءات قد اتخذت لحماية حياة الأشخاص المذكورين أعلاه وسلامتهم البدنية.

The Working Group is thus in a position to render an opinion on the basis of the submissions that have been made and finds that the arrest and detention of the above-mentioned persons resulted from the exercise of their rights to freedom of opinion and expression and to freedom of peaceful assembly and association, guaranteed under articles 19 and 20 of the Universal Declaration of Human Rights.

14. Consequently, the case of the detention of the above-mentioned persons would fall within Category II of the categories applicable to the consideration of the cases submitted to the Working Group.
14- وبالتالي، فإن قضية احتجاز الأشخاص المذكورين أعلاه تندرج في الفئة الثانية من الفئات المنطبقة على نظر القضايا المقدمة إلى الفريق العامل.

(a) Article 10, which guarantees the right of the above-mentioned persons to fair proceedings before an independent and impartial tribunal; and
(أ) المادة 10 التي تضمن حق الأشخاص المذكورين أعلاه في محاكمة منصفة أمام محكمة مستقلة ومحايدة؛

In the cases referred to in the three preceding paragraphs, the penalty shall be a term of imprisonment of three to seven years where the victim of the offence is under the age of 16, or where the offender is an ascendant of the victim, or a person in charge of his or her education or tutelage, or a person who has authority over him or her, or where the victim is employed for wages by the offender or by one of the above-mentioned persons.
