Article 21 of the Universal Declaration sets the basis for a democratic order by declaring that the will of the people shall be the basis of the authority of government, expressed through genuine and periodic elections.
12- وتحدد المادة 21 من الإعلان العالمي لحقوق الإنسان الأساس لإقامة نظام ديمقراطي معلنة أن إرادة الشعب يجب أن تكون أساس سلطة الحكم التي تتجلى من خلال انتخابات نزيهة ودورية.

It further specifies that, " the will of the people shall be the basis of the authority of government. "
وجاء فيها أيضاً أن " إرادة الشعب هي أساس سلطة الحكم " .

8. Reaffirms that the will of the people shall be the basis of the authority of government and that this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures;
8- تؤكد من جديد أن إرادة الشعب هي الأساس لسلطة الحكومة ويعبر عنها في انتخابات دورية وحقيقية تجري بالاقتراع العام على قدم المساواة ويكون الاقتراع سرياً أو بإجراءات تصويت حرّ مكافئ له؛

وهي تنص كذلك في الفقرة ٣ على أن إرادة الشعب هي مصدر سلطة الحكومة وأن هذه الارادة يعبر عنها بانتخابات دورية ونزيهة.

Those efforts were in accordance with one of the fundamental provisions of the Universal Declaration of Human Rights, namely, that the will of the people, as expressed in such elections, shall be the basis of the authority of government.
وتتفق هذه الجهود مع أحد اﻷحكام اﻷساسية في إعلان حقوق اﻹنسان، ألا وهو أن إرادة الشعب، كما تُعبر عنها هذه الانتخابات، هي اﻷساس الذي تستند إليه سلطة الحكومة.

As the Special Rapporteur has previously commented in detail (see E/CN.4/1994/58, paras. 80-86 and 159-184; A/50/734, paras. 52-58), the conditions necessary to ensure that the free will of the people is the basis of the authority of government do not exist in the present legal and political order of Iraq.
وكما سبق للمقرر الخاص أن لاحظ بالتفصيل )انظر E/CN.4/1994/58، الفقرات ٠٨-٦٨ و٩٥١-٤٨١؛ وA/50/734، الفقرات ٢٥-٨٥(، فإن الشروط الضرورية لضمان أن تكون الارادة الحرة للشعب هي أساس سلطة الحكم ليست موجودة في النظام القانوني والسياسي الحالي للعراق.

The right to political participation is enshrined in the Universal Declaration of Human Rights: " everyone has the right to take part in the government of his country, directly or through freely chosen representatives " and " the will of the people shall be the basis of the authority of government. "
35- وينص الإعلان العالمي لحقوق الإنسان على الحق في المشاركة السياسية: فقد جاء فيه أن " لكل شخص حق المشاركة في إدارة الشؤون العامة لبلده، إما مباشرة أو بواسطة ممثلين يُختارون بحرية " ، وأن " إرادة الشعب هي أساس سلطة الحكم " .

41.
