Article I of the Charter states:

In particular, Chapter I, Article 2, paragraph 4, of the Charter states that " All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations " .
إذ تنص الفقرة 4 من المادة 2 من الفصل الأول من الميثاق على ما يلي: ' ' يمتنع أعضاء الهيئة جميعا في علاقاتهم الدولية عن التهديد باستعمال القوة أو استخدامها ضد سلامة الأراضي أو الاستقلال السياسي لأية دولة أو على أي وجه آخر لا يتفق ومقاصد الأمم المتحدة``.

125. The Court came to this conclusion although Article 12 of the Charter states that " while the Security Council is exercising in respect of any dispute or situation the functions assigned to it in the present Charter, the General Assembly shall not make any recommendation with regard to that dispute or situation " .
125 - وخلصت المحكمة إلى هذه النتيجة مع أن المادة 12 من الميثاق تنص على أنه ' ' عندما يباشر مجلس الأمن، بصدد نزاع أو موقف ما، الوظائف التي رُسمت له في الميثاق، فليس للجمعية العامة أن تقدم أية توصية في شأن هذا النزاع أو الموقف``.
