Section 17 of the Child Law provides that every child shall have the right to be adopted in accordance with law, but the adoption shall be in the interests of the child.

(g) Review all cases of children held in military detention and ensure, as stipulated in article 112 of the Child Law (2008), that all children are separated from adults;

The Committee notes with concern in this regard that article 122 of the Child Law (2008) gives the Supreme State Security Court, in exceptional cases, jurisdiction over children above the age of fifteen.

(b) Ensure that all children, irrespective of nationality, gender or socio-economic background, have access to primary education without discrimination, in accordance with article 54 of the Child Law (2008);

36. The Committee welcomes the fact that the principle of the best interests of the child has been incorporated into article 3 of the Child Law (2008) according to which the principle will assume paramount priority in all decisions and measures taken or implemented concerning children.

41. The Committee urges the State party to take all necessary measures of ensuring effective implementation of article 3 of the Child Law (2008) and in particular to:
41- تحث اللجنة الدولة الطرف على اتخاذ جميع التدابير الضرورية لضمان التنفيذ الفعال للمادة 3 من قانون الطفل (2008) وعلى وجه الخصوص ما يلي:

(a) Enforce article 3(c) of the Child Law (2008) concerning the right of the child to freedom of expression, including the freedom to receive, seek and impart information;
(أ) إنفاذ المادة 3(ج) من قانون الطفل (2008) بشأن حق الطفل في حرية التعبير، بما في ذلك حرية تلقي المعلومات والتماس الحصول عليها ونقلها؛

77. In light of article 22 of the Convention and recalling articles 7 bis and 54 of the Child Law (2008), the Committee calls upon the State party to:

37. The Committee welcomes article 98 bis of the Child Law (2008) which stipulates that any person knowing that a child is at risk must provide immediate assistance to the child and article 22 of the Law on Combating Human Trafficking guaranteeing the protection of victims' right to rehabilitation and reintegration into society.
37- ترحب اللجنة بالمادة 98 مكرراً من قانون الطفل (2008) التي تنص على أنه يتوجب على كل من علم بتعرض طفل للخطر أن يقدم إليه ما في مكنته من المساعدة العاجلة0 وبالمادة 22 من قانون مكافحة الاتجار بالبشر التي تكفل حق الضحايا في إعادة التأهيل وإعادة الإدماج في المجتمع.

32. The Committee welcomes the definition of a child as a person under the age of 18 in article 2 of the Child Law (2008) and that marriage of persons under the age of 18 cannot be registered pursuant to new article 31 bis of the Civil Status Act No. 143 (1994).
32- ترحب اللجنة بتعريف الطفل بأنه شخص يقل عمره عن 18 عاماً في المادة 2 من قانون الطفل (2008) وبأن الزواج من الأشخاص الذين تقل أعمارهم عن 18 عاماً لا يمكن تسجيله وفقاً للمادة الجديدة 31 مكرر من قانون الأحوال الشخصية رقم 143 (1994).

While noting that students in military schools are not classified as members of the armed forces and cannot be called into active service in the event of an outbreak of hostilities on the basis of article 96 of the Child Law (2008), the Committee is concerned that this provides inadequate legal protection against recruitment.
وبينما تلاحظ اللجنة أن الطلبة في المدارس العسكرية غير مصنفين كأفراد في القوات المسلحة ولا يمكن استدعاؤهم للخدمة في حالة نشوب أعمال قتالية استناداً إلى المادة 96 من قانون الطفل (2008)، فإنها قلقة لأن ذلك يؤدي إلى حماية قانونية غير كافية من التجنيد.

22. With reference to its general comment No. 1 (2001) on the aims of education and in line the objectives of child education outlined in article 53 of the Child Law (2008), the Committee recommends that the State party include human rights education in the school curricula, with special reference to crimes covered by the Optional Protocol.
22- وبالإشارة إلى تعليق اللجنة العام رقم 1(2001) بشأن أهداف التعليم وتماشياً مع أهداف تعليم الطفل الواردة في المادة 53 من قانون الطفل (2008)، توصي اللجنة الدولة الطرف بإدراج التثقيف في مجال حقوق الإنسان في المناهج المدرسية، مع إشارة خاصة إلى الجرائم التي يغطيها البروتوكول الاختياري.

It further notes the State party's obligation under article 7 (bis)(b) of the Child Law (2008) to secure children a healthy and secure upbringing away from armed conflict and ensure their non-involvement in military activities and that article 96(1) criminalizes any person who puts the child's safety, morals, health or life at risk.
كما تلاحظ اللجنة التزام الدولة الطرف بموجب المادة 7 (مكرراً) (ب) من قانون الطفل (2008) بأن تكفل للطفل تنشئة سالمة آمنة بعيدة عن النزاعات المسلحة، وضمان عدم انخراطه في الأعمال الحربية، وأن المادة 96(1) تجرم أي شخص بعرض أمن الطفل أو أخلاقه أو صحته أو حياته للخطر.

35. In addition to article 116 bis (d) of the Child Law (2008) protecting the rights of child victims and witnesses, the Committee welcomes the adoption of several protection measures, including training programmes on victim identification in prostitution and trafficking and training manuals and victim identification indicators.

Section 18(a) of the Child Law (1993) specifically states that the State shall adopt measures in order that mentally-retarded or physically disabled children have the right to acquire basic education (primary level) at special schools or vocational education, and the right to obtain special care and support from the State and the right to participate with dignity in the society.
وتنص المادة 18(أ) من قانون الطفل (1993) تحديداً على أن تعتمد الدولة تدابير بهدف تمكين الأطفال المصابين بتخلف عقلي أو ذوي الإعاقة الجسدية من حق الحصول على التعليم الأساسي (المستوى الابتدائي) في مدارس خاصة أو مهنية، وحقهم في الحصول على الرعاية الخاصة والدعم من الدولة، وحق المشاركة في المجتمع بكرامة.

While noting as positive the right of the child to be protected against all forms of violence in article 3 (a) of the Child Law (2008) and that, as indicated by the delegation, the Penal Code criminalizes domestic violence and provides double punishment if a parent causes bodily harm, the Committee is gravely concerned that all forms of violence against children are still not prohibited in domestic legislation.
وبينما تلاحظ اللجنة بنظرة إيجابية نص المادة 3(أ) من قانون الطفل (2008) على حق الطفل في الحماية من جميع أشكال العنف، وبتجريم قانون العقوبات، حسب قول الوفد، للعنف المنزلي ونصه على عقوبة مزدوجة إذا تسبب أحد الوالدين بالأذى الجسدي، فإنها تشعر بقلق شديد إزاء استمرار عدم حظر جميع أشكال العنف ضد الأطفال في التشريعات المحلية.

(b) Ensure that deprivation of liberty of children is only a measure of last resort and for the shortest period possible by putting in place a restorative juvenile justice system that promotes alternative measures to deprivation of liberty, such as diversion, probation, counselling, mediation, community service or suspended sentences, wherever possible, in line with article 107 of the Child Law (2008);
(ب) ضمان عدم حرمان الأطفال من الحرية إلا كملاذ أخير ولأقصر مدة ممكنة من خلال وضع نظام قضاء أحداث تصالحي يشجع على اتخاذ تدابير بديلة للحرمان من الحرية، مثل تحويل العقوبة أو الإخضاع للمراقبة أو تقديم المشورة أو الوساطة أو الخدمة المجتمعية أو وقف تنفيذ الأحكام، حيثما أمكن، وذلك تمشياً مع المادة 107 من قانون الطفل (2008)؛

While noting new article 291 of the Penal Code (1937) and article 116 bis (a) of the Child Law (2008), the Committee is particularly concerned that the engagement of the child in forced labour and improperly inducing consent, as an intermediary, for the adoption of a child are not explicitly prohibited and criminalized in the domestic legislation in accordance with articles 2 (a) and 3, paragraph 1 (a)(i) c and (a) (ii), of the Optional Protocol.
