It wishes to draw the attention of the State party to the fact that reporting is an obligation under article 9 of the Convention and that non-compliance in this regard creates serious obstacles to the effective functioning of the monitoring system set up by the Convention.

It notes with concern that the procedures for adoption in religious and civil courts are not in full conformity with article 21 of the Convention and that the principle of the best interests of the child is not always subject to the principal consideration during these procedures.

In this respect, the Committee has consistently affirmed that discrimination against indigenous peoples falls under the scope of the Convention and that all appropriate means must be taken to combat and eliminate such discrimination.

4.12 The State party submits that the applicant has failed to establish a prima facie case for the purpose of admissibility of her communication under article 22 of the Convention and that the communication is therefore manifestly unfounded and should be declared inadmissible.

The Committee recommends that the State party comply fully with the obligations under article 4 of the Convention and that the necessary legislative measures be taken in order to give full effect to the provisions of that article and to declare illegal and prosecute incitement to ethnic hatred and racial violence.
وتوصي اللجنة بأن تمتثل الدولة الطرف على نحو تام للالتزامات بموجب المادة 4 من الاتفاقية وأن تتخذ التدابير التشريعية اللازمة بغية تطبيق أحكام هذه المادة على أكمل وجه وإعلان عدم قانونية أعمال التحريض على الكره الإثني والعنف العرقي ومقاضاة مرتكبيها.

223. It is noted that the State Party does not envisage making the declaration provided for in article 14 of the Convention, and that a number of members of the Committee requested the State Party to reconsider its position on this matter.
٢٢٣ - يجدر بالملاحظة أن الدولة الطرف لا تفكر في إصدار اﻹعلان المنصوص عليه في المادة ١٤ من الاتفاقية وأن عددا من أعضاء اللجنة طلبوا إلى الدولة الطرف إعادة النظر في موقفها بشأن هذه المسألة.

49. The Committee is pleased to learn that Guatemala has begun the process of making the declaration under article 22 of the Convention and that its representatives do not see any obstacle to such a declaration.
٤٩ - واللجنة مرتاحة لعلمها أن غواتيمالا قد بدأت عملية إصدار اﻹعلان المنصوص عليه في المادة ٢٢ من الاتفاقية وأن ممثليها لا يرون أن هناك عقبة تقف أمام إصدار ذلك الاعلان.

172. The Committee regrets that the Government of El Salvador has not taken due consideration of the provisions of article 4 of the Convention and that restrictions in the national budget affecting social programmes have been detrimental to the protection of the rights of children.

The Committee notes with interest that the State party's legislation appears to be generally in conformity with article 4 of the Convention and that under article 62 of the Penal Code, racial discrimination is an aggravating circumstance in the commission of criminal offences.

56. The Committee encourages the State party to undertake a review of its national legislation in order to ensure its full compatibility with the principles and provisions of the Convention and that the whole range of rights provided for in the Convention find expression in domestic legislation, policy and actions.
٦٥- وتشجع اللجنة الدولة الطرف على أن تجري مراجعة لتشريعاتها الوطنية بقصد كفالة اتفاقها الكامل مع مبادئ وأحكام الاتفاقية وكي تجد المجموعة الكاملة من الحقوق المنصوص عليها في الاتفاقية تعبيراً لها في التشريعات، والسياسات والاجراءات المحلية.

(30) The Committee reiterates its previous recommendation that the State party should ensure that migration procedures, including deportation and expulsion (CMW/C/ECU/CO/1, para. 26), are in accordance with article 22 of the Convention and that they are exceptional procedures of an administrative nature and are not handled by the criminal justice system.
(30) وتكرر اللجنة توصيتها السابقة بأن تكفل الدولة الطرف توافق إجراءات الهجرة، بما فيها الترحيل والطرد (الوثيقة CMW/C/ECU/CO/1، الفقرة 26)، مع أحكام المادة 22 من الاتفاقية وتطبيقها كإجراءات استثنائية ذات طابع إداري خارج عن نطاق العدالة الجنائية.

The Committee stressed that it had the duty to monitor the implementation of the Convention and that the noncompliance of a State party with its reporting obligations constituted an infringement of the provisions of the Convention.
وشددت اللجنة على أن من واجبها رصد تنفيذ الاتفاقية وعلى أن عدم تقيّد دولة طرف ما بالتزاماتها بتقديم التقارير يشكل انتهاكا لأحكام الاتفاقية.

The Committee notes that such marriages are prohibited by article 16, paragraph 2, of the Convention, and that such marriages have serious consequences for girls, including with regard to health.
وتلاحظ اللجنة أن هذه الزيجات تحظرها الفقرة 2 من المادة 16 من الاتفاقية وأنها تخلف عواقب خطيرة تضر الفتيات، لا سيما صحتهن.

In particular the Committee urges the State party to ensure respect for article 37 (a) of the Convention and that no persons under 18 is sentenced to the death penalty or life imprisonment without possibility of release.
وبصفة خاصة، تحث اللجنة الدولة الطرف على ضمان احترام المادة 37 (أ) من الاتفاقية وضمان ألا يُعاقب أي شخص لم يبلغ سن 18 سنة بعقوبة الإعدام أو السجن مدى الحياة دون أن تكون هناك إمكانية لإطلاق سراحه.

(c) To review its legislation relating to the custody of the child with a view to ensuring that all decisions taken are based on the principle of the best interests of the child in line with articles 3 and 12 of the Convention and that children can no longer be withdrawn from their mother's custody if she remarries; and
