17. He commended the Commission's work on promoting the implementation of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards and expressed the hope that all work on revision of the UNCITRAL Arbitration Rules would be guided by the principle of consensus.

" 1. Recommends that article II, paragraph 2, of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, done at New York, 10 June 1958, be applied recognizing that the circumstances described therein are not exhaustive;
" 1- توصي بأن تطبق الفقرة 2 من المادة الثانية من اتفاقية الاعتراف بقرارات التحكيم الأجنبية وتنفيذها، التي حُرّرت في نيويورك في 10 حزيران/يونيه 1958، مع إدراك أن الحالات المذكورة فيها ليست حصرية؛

Therefore, the recommendation that article II, paragraph 2, of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards " be applied recognizing that the circumstances described therein are not exhaustive " should be accepted provided that there is a record in writing.
ومن ثم، فإن التوصية بأن تُطبَّق الفقرة 2 من المادة الثانية من اتفاقية الاعتراف بقرارات التحكيم الأجنبية وتنفيذها " مع الاعتراف بأن الظروف الموصوفة فيها ليست شاملة لجميع الحالات " ، ينبغي أن تُقبل شريطة أن يكون هناك سجل مكتوب.

Article II(2) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards states as follows:

His delegation was encouraged by the celebration of the fortieth anniversary of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, and agreed with the recommendation made on New York Convention Day that legal issues not covered by that Convention should be considered.
وأعرب وفد بلده عن تفاؤله بالاحتفال بالذكرى السنوية اﻷربعين لاتفاقية الاعتراف بقرارات التحكيم اﻷجنبية وتنفيذها، ووافق على التوصية المعلنة في يوم اتفاقية نيويورك بأن ينظر في المسائل القانونية غير المشمولة في تلك الاتفاقية.

4. The Secretariat had organized a special event for 10 June 1998 to commemorate the fortieth anniversary of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
