My dissenting opinion on this communication - the majority not considering that article 6 of the Covenant was violated - is based on the following grounds:

It was not certain that such was the case in Togo, or that article 25 of the Covenant was fully respected; moreover,the actual legal status of that instrument as a whole in Togo, remained unclear.

3. The Committee welcomes the constructive dialogue held with the State party, and notes that its implementation of the Covenant was considered by the Committee in 2001 in the absence of a report.
3- وترحّب اللجنة بالحوار البناء الذي أجرته مع الدولة الطرف، التي استعرض مدى تنفيذها للعهد في عام 2001 في غياب تقديمها لتقرير.

The Committee is also of the view that article 7, read in conjunction with article 2, paragraph 3 of the Covenant was breached with regard to the author's wife and his parents.
