إذا كانت تفاصيل العقد تذكر الوقت المتوقع لوصول البضائع أو تبين كيفية الحصول على معلومات بشأن ما إذا كانت البضائع قد سلمت، يفترض أن ذلك الشخص، عندما أصبح حائزا، كان يعلم، أو كان يمكن في حدود المعقول أن يكون قد علم، بتسليم البضائع.

(ii) the carrier refuses delivery because the person claiming to be the consignee does not properly identify itself as the consignee, or (iii) the carrier is, after reasonable effort, unable to locate the consignee in order to request delivery instructions, the carrier may so advise the controlling party and request instructions in respect of the delivery of the goods.

It was explained that in such a case, the carrier had an obligation to advise the controlling party of the failure of the holder to claim delivery, but when the controlling party could not be identified, the carrier was entitled to ask instructions of the shipper in respect of the delivery of the goods.
ولوحظ توضيحا لذلك أن على الناقل في تلك الحالة التزام إشعار الطرف المسيطر بعدم مطالبة الحائز بتسلم البضاعة، ولكن عندما يتعذّر تحديد الطرف المسيطر يحق للناقل أن يطلب من الشاحن تعليمات بشأن تسليم البضاعة.

In subparagraph (c), the carrier, if unable to locate the controlling party, was told to advise the shipper, which should then give instructions in respect of the delivery of the goods.
وفى الفقر الفرعية (ج)، إذا عجز الناقل عن تحديد مكان الطرد المراقب يطلب إليه إبلاغ الشاحن، الذي ينبغي حينئذ أن يصدر تعليماته بخصوص تسليم البضاعة.

One suggestion was made to clarify the final phrase of draft paragraph 5 with text such as " the time and location of such handing over is the time and location of the delivery of the goods " , but it was thought that general drafting would accomplish that goal.
وقُدِّم اقتراح مفاده أن تُوضَّـح العبارة الأخيرة في مشروع الفقرة (5) عن طريق نص يبيِّـن أن " وقت ومكان هذا التسليم هما وقت ومكان تسليم البضاعة " ، ولكن رئي أن الصياغة العامة ستحقّق ذلك الهدف.

Article 57(1)(b) CISG was not applicable because, under the contracts, the buyer was to pay for each delivery not at the place of the delivery of the goods but by bank transfer within 90 days of the date indicated in the commercial invoice.
