يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أجهزة أو موظفي الدولة المشار إليهم في المادة ٥ وكذا الكيانات المشار إليها في المادة ٦، سواء احترمت صلاحياتها أو تعليماتها المحددة بمقتضى القانون الداخلي لتلك الدولة أم لا.

1. Each application by a State enterprise or one of the entities referred to in regulation 9 (b) shall be accompanied by a certificate of sponsorship issued by the State of which it is a national or by which or by whose nationals it is effectively controlled.
١ - يُشفع بكل طلب مقدم من إحدى المؤسسات الحكومية أو من أحد الكيانات المشار إليها في الفقــرة الفرعيـــة (ب) من الـمادة 9 شهادة تزكية تُصدرها الدولة التي تعد المؤسسة أو الكيان من رعاياها أو التي تسيطر عليها أو عليه سيطرة فعلية.

2. The credentials shall be issued either by the Head of State or Government or by the Minister for Foreign Affairs or any person authorized by them, or, in the case of the entities referred to in article 305, paragraph 1 (f), of the Convention, by another competent authority.
٢ - يصدر وثائق التفويض إما رئيس الدولة أو الحكومة أو وزير الخارجية أو أي شخص يأذنون له؛ وتصدرها، في حالة الكيانات المشار اليها في الفقرة ١ )و( من المادة ٣٠٥ من الاتفاقية، سلطة مختصة أخرى.
