280. On the subject of types of unions, article 360 of the Federal Labour Act establishes the following categories:

43. With reference to article 40 of the Convention, the Committee is concerned at the fact that article 372 of the Federal Labour Act prohibits foreigners from forming part of the leadership of trade unions.

137. Articles 356, 364, 365 and 366 of the Federal Labour Act set out the following substantive conditions for forming a trade union or professional association:

139. With regard to restrictions on the exercise by workers of the right to form and join trade unions, article 358 of the Federal Labour Act provides that no one may be obliged to join or not to join a trade union.
٩٣١- بالنسبة للقيود على ممارسة العمال حقوقهم في تأسيس النقابات والانتساب إليها، تنص المادة ٨٥٣ من قانون العمل الاتحادي على عدم جواز إجبار أي كان على الانتساب إلى نقابة أو عدم الانتساب إليها.

152. Article 356 of the Federal Labour Act states that a union is an association of workers or employers constituted for the study, improvement and protection of the rights of the persons concerned.
٢٥١- تشير المادة ٦٥٣ من قانون العمل الاتحادي إلى أن النقابة هي تجمّع لعمال أو أصحاب عمل، تتأسس بهدف درس وتحسين مصالحهم والدفاع عنها.

(d) It is forbidden to use persons aged under 18 for services outside Mexico, except in the case of technicians, professionals, performing artists, sportsmen and specialist workers in general (article 29 of the Federal Labour Act).
)د( يمنع استخدام الذين لم يتجاوزوا الثامنة عشرة من العمر في أعمال خارج الجمهورية، إلا إذا كانوا تقنيين، أو مهنيين، أو فنانين، أو رياضيين، أو عمالاً متخصصين )المادة ٩٢ من قانون العمل الاتحادي(.

177. Thus in Mexico the only method of fixing minimum wages established by law is that referred to in Article 123, Part A, section VI, of the Constitution and articles 570-574 of the Federal Labour Act.

179. The Technical Office is required to submit to the Council of Representatives, not later than on 30 November, the report referred to in section V of article 562 of the Federal Labour Act.

208. The procedure for fixing and adjusting wages, as established in accordance with Article 123, section VI, of the Constitution and articles 570-574 of the Federal Labour Act, comprises the following elements:
208- وإجراءات تحديد وتعديل الأجور المقررة وفقاً للمادة 123، القسم السادس، من الدستور والمواد 570-574 من قانون العمل الاتحادي تشمل العناصر التالية.

210. The Technical Office of the commission is required to submit to the Council of Representatives, not later than on 30 November, the report referred to in section V of article 562 of the Federal Labour Act.
210- ويتعيَّن على المكتب التقني التابع للجنة أن يقدِّم إلى مجلس الممثلين في موعد لا يتجاوز 30 تشرين الثاني/نوفمبر التقرير المشار إليه في القسم الخامس من المادة 562 من قانون العمل الاتحادي.

262. The above is reaffirmed in the provisions of article 3, article 133 (section I) and article 164 of the Federal Labour Act, which read as follows:
262- ويتأكد ما سبق في أحكام المواد 3 و133 (القسم الأول) و164 من قانون العمل الاتحادي التي تنص على ما يلي:

290. In article 381 of the Federal Labour Act the legislator recognizes the negative aspect of freedom of association, namely the right of the worker not to join a union or to leave a union of which he is a member if he considers it desirable.
290- يعترف المشرِّع في المادة 381 من قانون العمل الاتحادي بالجانب السلبي لحرية تكوين النقابات، أي حق العمال في عدم الانضمام إلى نقابة أو ترك أي نقابة إذا رأوا ذلك أمراً مستصوباً.

299. It should be mentioned here, concerning express limitations placed upon the right to function of trade unions contained in labour legislation, the following is found in article 378 of the Federal Labour Act:
299- وينبغي أن نذكر هنا أنه فيما يتعلق بالتقييدات الصريحة الواردة في تشريع العمل لحق تشغيل النقابات، نجد ما يلي في المادة 378 من قانون العمل الاتحادي:

300. The provisions recognizing the freedom of unions to negotiate collective agreements are to be found in articles 386-403 of the Federal Labour Act.
