ولما لم يكن من المستصوب توسيع نطاق الموضوع ليشمل قانون البيئة البشرية ككل، فقد ترى اللجنة أن تنظر في مبدأ التحوط الذي كان موضع اهتمام عام كبير، خاصة وأنه سبق تطبيقه في عدد من الاتفاقيات وفي كثير من القوانين الوطنية، ولكنه يحتاج إلى تعريف أوضح.

Reaffirming that the United Nations Environment Programme was established to protect and promote the enhancement of the human environment and that the quality of human life must constitute its central concern,
وإذ يؤكد من جديد أن برنامج اﻷمم المتحدة للبيئة قد أنشئ لحماية البيئة البشرية ودعم الارتقاء بها وأن نوعية الحياة البشرية يجب أن تشكل الاهتمام الرئيسي للبرنامج،

Article 162 of the Criminal Act provides for the penalization of the criminal offence of pollution of the human environment, which raises the issue of responsibility of individuals acting both in their private and their official capacity.
فالمادة ٢٦١ من القانون الجنائي تنص على اعتبار تلويث البيئة البشرية فعلاً جنائياً يخضع للعقوبة، وهذا يطرح مسؤولية اﻷفراد عن أفعالهم التي يقومون بها بصفتهم الشخصية وبصفتهم الرسمية.

Its opening words evidently do not refer to a single “obligation ... for the safeguarding and preservation of the human environment”; international law contains a range of environmental norms and cannot be expressed in terms of a single rule.
فلا ريب في أن عباراتها الافتتاحية لا تشير إلى " التزام " واحد فحسب " لحماية البيئة البشرية والحفاظ عليها " ؛ فالقانون الدولي يتضمن طائفة من القواعد البيئية ولا يمكن التعبير عنه بقاعدة واحدة فحسب.

In that sense, the Convention represents a new and unsurpassed affirmation of responsibility-sharing and interdependency among generations, States, civil society and new transnational actors -- non-governmental organizations, community associations and the international community players -- in the safeguarding of the human environment.
ومن هذا المنطلق، تمثل الاتفاقية تأكيدا جديدا وغير مسبوق لتقاسم المسؤولية والترابط بين الأجيال والـــدول والمجتمع المدني والجهات الفاعلة الجديدة عبر الوطنية - المنظمات غير الحكومية، والجمعيات الأهلية، وأوساط المجتمع الدولي الفاعلة - في حماية البيئة البشرية.

A report of the Secretary-General entitled " Problems of the human environment " cited the " explosive growth of human populations " as first among the portents of a crisis of worldwide scope concerning the relation between man and his environment (United Nations, 1969).
فقد وردت في تقرير للأمين العام معنون " مشاكل البيئة البشرية " إفادة مؤداها أن " النمو الانفجاري في أعداد البشر " يأتي في مقدمة الأزمات المنذرة بالسوء على نطاق العالم فيما يتعلق بالعلاقة بين الإنسان والبيئة (الأمم المتحدة، 1969).

It contains a set of " common principles to inspire and guide the peoples of the world in the preservation and enhancement of the human environment " , although it does not specifically refer to the protection of the atmosphere.

107. The Declaration on Social Progress and Development stipulated that social progress and development should aim at the attainment of the following main goals, inter alia, " a steady increase in the use of science and technology for the benefit of the social development of society " and " the protection and improvement of the human environment " (art. 13).

البيئة اﻹنسانية لخطر جسيم يشكل انتهاكا للمبادئ " التي أصبحت اﻵن راسخة الجذور في ضمير البشرية بحيث صارت على وجه الخصوص من القواعد اﻷساسية للقانون الدولي العام " )٧٣١(.
