Article 11 of the Immigration Control Act prohibits the entry of foreigners with mental disabilities who are void of the capacity to make decisions on their own and have no person to assist their sojourn, but this provision is one of the measures the government takes to make people who invite them or their relatives guarantee their safety during the stay.
83- وتحظر المادة 11 من قانون مراقبة الهجرة دخول الأجانب ذوي الإعاقات العقلية الفاقدين القدرة على اتخاذ القرارات بأنفسهم وغير المصحوبين بشخص يساعدهم في فترة إقامتهم في كوريا، غير أن الهدف من هذا الحكم هو حمل الأشخاص الذين يوجهون لهم الدعوة أو أقاربهم على ضمان حمايتهم خلال فترة إقامتهم في البلد.

(a) Recommendation for Departure. The head of the immigration office or a branch office may recommend that an alien who has committed a minor violation of the Immigration Control Act depart voluntarily from the Republic of Korea (art. 67 of the Immigration Control Act).
(أ) التوصية بالمغادرة - يجوز لرئيس مكتب الهجرة الرئيسي أو الفرعي أن يوصي بأن يغادر أجنبي ارتكب انتهاكا بسيطا لقانون مراقبة الهجرة لجمهورية كوريا مغادرة طوعية (المادة 67 من قانون مراقبة الهجرة).

However, there are exceptions for those who have committed insurrection, foreign aggression or other violations of the relevant provisions of the Criminal Act (art. 46, para. 2, of the Immigration Control Act).

To execute a deportation order, the order shall be presented to the person who is subject to it, and he shall be repatriated without delay to the country in which he has a nationality or citizenship (arts. 62 and 64 of the Immigration Control Act).
ولأغراض تنفيذ أمر الترحيل، يُسلَّم الأمر إلى الشخص الذي صدر بشأنه ويعاد هذا الشخص دون تأخير إلى موطنه أو إلى البلد الذي يحمل جنسيته (المادتان 62 و 64 من قانون مراقبة الهجرة).

His detention will be indefinite as long as the deportation order is neither revoked nor withdrawn, since article 63 of the Immigration Control Act provides that " if it is impossible to immediately repatriate a person who is subject to a deportation order, out of the Republic of Korea " the person may be detained " until the repatriation is possible " .
وسيظل محتجزاً إلى أجل غير مسمّى طالما لم يتم إلغاء أمر الترحيل أو سحبه. ذلك أن المادة 63 من قانون مراقبة الهجرة تنصّ على أنه في حال استحالة إعادة شخص ما صدر في حقه أمر بالترحيل من جمهورية كوريا إلى بلده الأصلي فوراً " فإنه يجوز احتجازه حتى تتيسر إعادته إلى بلده " .

The Committee notes that in the present case, the author was detained pursuant to article 63(1) of the Immigration Control Act, which provides that an individual against whom a deportation order was adopted may be placed in custody if that individual cannot be repatriated promptly.
