وقد دُعيت منظمة الطيران المدني الدولي، لدى بدء سريان مفعول الاتفاقية بصيغتها التي تُطبّق على معدات الطائرات، للقيام بمهمة السلطة الإشرافية بشأن السجل الدولي بمقتضى بروتوكول معدات الطائرات.

7. The Cape Town Convention also provides for the designation of a body to supervise the registrar and the operation of the international registry.

The Subcommittee was informed that in the first 10 months of operation of the international registry for aircraft objects, 33,500 interests were registered in 15,000 aircraft, helicopters and aircraft engines and that the International Registry had already accounted for over 50 per cent of the world's commercial aircraft transactions.

(h) Set and periodically review the structure of fees to be charged for the services and facilities of the international registry;

25. The assumption of the function of supervisory authority by the United Nations would entail costs, including set-up costs of the international registry, staff resources and meeting costs.
25- من شأن تولّي الأمم المتحدة وظيفة السلطة الإشرافية أن تترتّب عليه تكاليف متعددة، ومنها تكاليف إنشاء السجل الدولي وتكاليف توفير الموارد من الموظفين وتكاليف الاجتماعات.

In addition, the contract with the registrar should contain provisions governing payments by the registrar to the United Nations to cover the costs of the supervisory authority and should stipulate that all initial investments, costs and expenses necessary for the establishment and operation of the international registry shall be borne by the registrar.

Among other important resolutions, the diplomatic Conference had invited the governing bodies of the International Telecommunications Union (ITU) to consider the matter of ITU becoming the supervisory authority of the international registry to be set up under the Protocol;
وكان من بين القرارات المهمة الأخرى التي اتخذها هذا المؤتمر دعوته الهيئات التشريعية للاتحاد الدولي للاتصالات إلى النظر في مسألة اضطلاع الاتحاد بدور السلطة المشرفة على السجل الدولي الذي سيُنشأ بموجب البروتوكول؛

(d) After consultation with the contracting States, make or approve and ensure the publication of regulations pursuant to the space assets protocol dealing with the operation of the international registry;

22. A first envisaged function of the supervisory authority is to establish or to provide for the establishment of the international registry (art. 17, para. 2 (a), of the Cape Town Convention).
22- وأول وظيفة متوخّـاة للسلطة الإشرافية هي إنشاء، أو العمل على إنشاء، السجل الدولي (انظر الفقرة 2 (أ) من المادة 17 من اتفاقية كيب تاون).

29. The inviolability and immunity of assets, documents, databases and archives of the international registry is provided for in the Cape Town Convention and does not require further specification (art. 27, para. 4, of the Convention).
29- وتنص اتفاقية كيب تاون على أن تكون موجودات السجل الدولي ووثائقه وقواعد البيانات الخاصة به ومحفوظاته مصونة ومحصّنة، ولا تستلزم المزيد من التحديد (الفقرة 4 من المادة 27 من الاتفاقية).

It is the supervisory authority that shall own all proprietary rights in the databases and archives of the international registry (art. 17, para. 4, of the Convention) and that may waive the inviolability and immunity of assets, documents, databases and archives (art. 27, para. 6, of the Convention).
والسلطة الإشرافية هي التي يجب أن تملك جميع حقوق الملكية في قواعد بيانات السجل الدولي ومحفوظاته (الفقرة 4 من المادة 17 من الاتفاقية)، ولا يجوز لها أن ترفع الحماية والحصانة عن تلك الموجودات والوثائق وقواعد البيانات والمحفوظات (الفقرة 6 من المادة 27 من الاتفاقية).

The extension of the registration requirements for security rights to true leases is reflected at the international level in the Convention on International Interests in Mobile Equipment, which extends the scope of the international registry contemplated by the Convention beyond security rights and financial leases to include leasing arrangements.
40- وعلى الصعيد الدولي، يتجسد توسيع شروط التسجيل المتعلقة بالحقوق الضمانية لتشمل الإيجارات الصحيحة في اتفاقية الضمانات الدولية على المعدات المنقولة، إذ توسع هذه الاتفاقية نطاق السجل الدولي المطروح فيها ليتعدى الحقوق الضمانية والإيجارات التمويلية إلى ترتيبات الإيجار.

The Committee also noted that, pending the entry into force of the Protocol, a Preparatory Commission for the Establishment of the international registry for Space Assets had been established to act with full authority as the provisional supervisory authority of the future international registry and that the Preparatory Commission operated under the guidance of the Unidroit General Assembly.
228- ولاحظت اللجنة أيضاً أنه ريثما يبدأ نفاذ البروتوكول، أُنشئت لجنة تحضيرية معنية بإنشاء السجل الدولي للموجودات الفضائية لتعمل بتفويض كامل بصفتها السلطة المشرِفة مؤقتا على السجل الدولي المقبل، وأنَّ هذه اللجنة التحضيرية تعمل بتوجيه من الجمعية العامة لليونيدروا.

The Subcommittee also noted that the Preparatory Commission for the Establishment of the international registry for Space Assets, acting as the Provisional Supervisory Authority of the future international registry, had successfully held two sessions, in May 2013 and January 2014.
ولاحظت اللجنة الفرعية أيضا أنَّ اللجنة التحضيرية المعنية بإنشاء السجل الدولي للموجودات الفضائية، التي تقوم بدور السلطة الإشرافية المؤقتة على السجل الدولي المقبل، قد عقدت بنجاح دورتين في أيار/مايو 2013 وكانون الثاني/يناير 2014.

(c) The Unidroit Governing Council had taken note of the progress in negotiations for the establishment of the international registry for railway rolling stock and of the first meeting of the Preparatory Commission for the Establishment of the international registry for Space Assets (Rome, 6-7 May 2013).
(ج) أنَّ مجلس إدارة اليونيدروا أحاط علماً بالتقدُّم المحرز في المفاوضات الجارية من أجل إنشاء السجل الدولي للمعدات الدارجة على السكك الحديدية، وبنتائج الاجتماع الأول للجنة التحضيرية المعنية بإنشاء السجل الدولي للموجودات الفضائية (روما، 6-7 أيار/مايو 2013).

The Preparatory Commission established at the diplomatic Conference in Luxembourg to act as Provisional Supervisory Authority of the international registry for railway rolling stock pending entry into force of the Protocol, at its second session, held in Rome from 8 to 10 April 2008, appointed CHAMP, a company based in Luxembourg, as Registrar of the future International Registry for railway rolling stock.
