4. In its submissions under rule 91 of the rules of procedure, the State party contended that the communication was inadmissible because of non-exhaustion of domestic remedies, since the author had failed to petition the Judicial Committee of the Privy Council for special leave to appeal, pursuant to section 110 of the Jamaican Constitution.

6.2 The State party further argues that the author may still seek redress under section 25 of the Constitution for any alleged violation of his constitutional rights; in this context, it is noted that the right in article 14, paragraph 3 (c), of the Covenant is similar to the right protected under section 20, paragraph 1, of the Jamaican Constitution.

4.2 The State party submits that the author's right to a fair trial without undue delay and the right to access to court for the determination of criminal charges against him are guaranteed in section 20 (1) of the Jamaican Constitution.

Reference is made to the judgement of the Judicial Committee of the Privy Council in the case of Pratt and Morgan, in which the complainants' prolonged detention on death row was held to be contrary to section 17 (1) of the Jamaican Constitution.b

6.5 With respect to the claim of the author's ill-treatment on death row during 1991, the Committee noted the State party's claim that the case was inadmissible because of the author's failure to file a constitutional motion under section 25 of the Jamaican Constitution.
٦-٥ وفيما يتعلق بادعاء إساءة معاملة صاحب البلاغ لدى وجوده في جناح المحكوم عليهم باﻹعدام خلال عام ١٩٩١، أحاطت اللجنة علما بما دفعت به الدولة الطرف من عدم جواز قبول هذا الادعاء لعدم قيام صاحب البلاغ بالطعن في الحكم أمام المحكمة الدستورية بناء على المادة ٢٥ من الدستور الجامايكي.

3.1 The author contends that he was denied a fair hearing by an impartial tribunal, in violation of section 20 (1) of the Jamaican Constitution and article 14 of the Covenant.
