115. Article 7 of the Juvenile Delinquents Act No. 18 of 1974 stipulates that, if the parents or legal guardian of the juvenile do not meet the moral requirements or are incapable of undertaking his upbringing, he must be placed in the custody of a member of his family.
٥١١- فقد نصت المادة ٧ من قانون اﻷحداث الجانحين رقم ٨١ لعام ٤٧٩١ على أنه إذا لم تتوفر في أبوي الحدث أو في وليه الشرعي الضمانات الاخلاقية أو لم يكن باستطاعتهم القيام بتربيته، سلم إلى أحد أفراد أسرته.

This measure can be taken during the hearing of the case and before judgement is passed (art. 47 of the Juvenile Delinquents Act).
ويمكن اتخاذ هذا التدبير أثناء رؤية الدعوى وقبل إصدار الحكم )المادة ٧٤ من قانون اﻷحداث الجانحين(.

35. Article 2 of the Juvenile Delinquents Act further stipulates: " No juvenile shall be liable to criminal prosecution for an offence that he committed when he was under seven years of age " .
٥٣- كما نصت المادة الثانية من قانون اﻷحداث الجانحين على أنه " لا يلاحق جزائياً الحدث الذي لم يتم السابعة من عمره حين ارتكاب الفعل " .

109. Syrian law regards the dereliction of family duties and the abandonment of children as punishable offences (art. 9 of the Juvenile Delinquents Act and art. 486 of the Penal Code based on arts. 484 and 485 thereof).
٩٠١- واعتبر المشرع السوري إهمال واجبات اﻷسرة وتسييب اﻷولاد جريمة يعاقب عليها )م ٩ من قانون اﻷحداث الجانحين والمادة ٦٨٤ بدلالة المادتين ٤٨٤ و٥٨٤ عقوبات(.

According to article 40 of the Juvenile Delinquents Act: " If an offence is committed by juveniles acting in association with adults, a distinction shall be drawn between the two categories and a special file shall be compiled for the juveniles, containing all the details of their involvement ... " .
٠٣٢- ونصت المادة ٠٤ من قانون اﻷحداث الجانحين على أنه " اذا اشترك في الجريمة الواحدة أحداث وغير أحداث يفرّق بينهم وينظم لﻷحداث منهم اضبارة خاصة تحتوي على جميع ما يتعلق بهم " .

241. The purpose of release on probation is to monitor the behaviour of juvenile delinquents, reform them through counselling, help them to avoid misbehaviour and facilitate their social integration (art. 30 of the Juvenile Delinquents Act).
١٤٢- ويهدف تدبير الحرية المراقبة إلى مراقبة سلوك الحدث الجانح والعمل على إصلاحه بإسداء النصح له ومساعدته على تجنب السلوك السيء وتسهيل اندماجه في المجتمع )المادة ٠٣ من قانون اﻷحداث الجانحين(.

253. Judgements handed down against juveniles are not entered in the judicial register and, consequently, juveniles cannot be sentenced on the basis of their past record (repeated offenders), nor are they liable to ancillary or additional penalties (art. 58 of the Juvenile Delinquents Act).
٣٥٢- ولا تسجل اﻷحكام الصادرة بحق اﻷحداث في السجل العدلي، وبالتالي، لا تعمل بشأنهم أحكام الاسبقيات )التكرار(، كما لا تطبق بحقهم العقوبات الفرعية أو الاضافية )م٨٥ من قانون اﻷحداث الجانحين(.

231. According to article 44 of the Juvenile Delinquents Act: " At any stage of the proceedings, the court may summon the juvenile's guardian or tutor, or the person in whose custody the juvenile is placed, or a representative of the body in the custody of which the juvenile is placed, together with a
١٣٢- ونصت المادة ٤٤ من قانون اﻷحداث الجانحين على أنه " تدعو محكمة اﻷحداث في جميع أدوار الدعوى ولي الحدث أو وصيه أو الشخص المسلم اليه أو ممثل الجهة المسلم اليها ومندوب مكتب الخدمة الاجتماعية إن وجد وإلا مراقب السلوك، وتستمع إلى من تدعوه مع الحدث " .

Appeals against judgements handed down by district juvenile courts are lodged with the Court of Cassation, while those handed down by a single juvenile judge are lodged with a court of appeal (art. 50 of the Juvenile Delinquents Act).
وتقبل اﻷحكام الطعن من ولي الحدث أو وصيه أو الشخص المسلم اليه، ويكون الطعن أمام محكمة النقض اذا صدرت عن محاكم اﻷحداث الجماعية وأمام محكمة الاستئناف اذا صدرت عن قاضي اﻷحداث المنفرد )المادة ٠٥ من قانون اﻷحداث الجانحين(.
