468. Article 3 of the Law on Education defines the basic principles of State policy in education, namely:
468 - تعرف المادة 3 من قانون التعليم المبادئ الأساسية لسياسة الدولة في التعليم، أي:

Article 6 of the Law on Education stipulates that the right to education is assured to anyone without discrimination of any kind, such as nationality, sex, race, age, origin and social status, political opinion and penal antecedents.
138- وتنص المادة 6 من قانون التعليم على أن الحق في التعليم مكفول للجميع دون تمييز من أي نوع، كالتمييز على أساس الجنسية والجنس والعرق والعمر والأصل والحالة الاجتماعية والرأي السياسي والسوابق الجنائية.

106. Article 6 of the Law on Education stipulates that the right to education is guaranteed, despite nationality, sex, race, age, original and social state, political membership and penal background.
١٠٦ - تشترط المادة ٦ من قانون التعليم أن الحق في التعليم مكفول، بغض النظر عن الجنسية ونوع الجنس والعِرق والسن واﻷصل والحالة والاجتماعية، والانتماء السياسي والخلفية الجزائية.

112. Because article 6 of the Law on Education is not directly followed, the Republic is now facing a situation where half of the trained staff are women.
١١٢ - ونظرا لعدم اتباع المادة ٦ من قانون التعليم بصورة مباشرة، تواجه الجمهورية حاليا وضعا تُشكل فيه النساء نصف الموظفين المدربين.

One positive example is that foreign citizens and apatrides (persons without nationality) are entitled to receive primary and secondary education in Brčko District in accordance with the provisions of the Law on Education, and international conventions, interState agreements and contracts made by Bosnia and Herzegovina, and contracts and agreements made by the Assembly of the Brčko District.

132. Article 6 of the Law on Education confirms the right to education, which is guaranteed, irrespective of nationality, sex, age, social origin and status, political or religious belonging, criminal records.
132- تكرّس المادة 6 من قانون التعليم الحق في التعليم، وهو حق مكفول بغض النظر عن الجنسية، ونوع الجنس، والعمر، والأصل الاجتماعي، والوضع الاجتماعي، والانتماء الديني أو السياسي، والسجل العدلي.

Paragraph 2 of article 5 of the Law on Education specifies that: " The State promotes the principles of democratic education and guarantees the right to education adapted to the pupils' needs on the basis of educational pluralism. "
وتنص الفقرة الفرعية ٢ من المادة ٥ من قانون التعليم بالضبط على أن " الدولة تقر مبادئ التعليم الديمقراطي وتضمن الحق في التعليم المتنوع على أساس التعدد التربوي " .

14. Under Article 41 of the Republic of Tajikistan Constitution and Article 6 of the Law on Education, Republic of Tajikistan citizens, regardless of nationality, race, sex, language, religion, political status or social or material status, are guaranteed the right to an education.
14 - إن الحق في التعليم مكفول بموجب المادة 41 من دستور جمهورية طاجيكستان والمادة 6 من قانون التعليم لمواطني جمهورية طاجيكستان بغض النظر عن القومية أو العنصر أو نوع الجنس أو اللغة أو الديانة أو المركز السياسي أو الاجتماعي أو المادي.

14. Article 5.3 of the Law on Education of the Republic of Azerbaijan, which was adopted in June 2009 specifies that the state guarantees the creation of the adequate conditions required for education provision for all citizens and does not allow deprivation from any grade, level and form of education.
14 - تنص المادة 5-3 من قانون التعليم في جمهورية أذربيجان الذي اعتمد في حزيران/ يونيه 2009 على أن تكفل الدولة تهيئة الظروف المناسبة اللازمة لتوفير التعليم لجميع المواطنين ولا تسمح بالحرمان من أي صف أو مستوى أو شكل للتعليم.

The Committee notes that article 118 of the Law on Education recognizes the right of persons belonging to national minorities to receive education in their mother tongue, and that the State party has ensured in practice that education conducted completely or partially in their mother tongue, or the study of their mother tongue, is available to children belonging to a number of minorities, including the Roma.
95- تلاحظ اللجنة أن المادة 118 من قانون التعليم تعترف بحق الأشخاص المنتمين إلى أقليات قومية في تلقي التعليم بلغتهم الأم، وأن الدولة الطرف تكفل للأطفال الذين ينتمون إلى عدد من الأقليات، بما فيها جماعات الروما، تلقي التعليم من الناحية العملية، سواء كلياً أو جزئياً، بلغتهم الأم أو الدراسة بلغتهم الأم.

The Bulletin for Personnel Allocation was issued on the basis of article 10 of the Law on Education, the 2006 amendment of which provides that universities' graduates, whose studies had been funded by the State or the municipal budgets, must work for the State " mandatorily allocated " for a period of two years, according to the order established by the Government of Belarus.

He also submits that, since article 10 of the Law on Education was not enacted until June 2006, during his education in the period 2001 - 2006, the rules on mandatory allocation of young specialists, whose education was paid by the State budget, did not exist and therefore the courts applied the law retroactively in violation of his rights under article 14, paragraph 1, of the Covenant.
وهو يزعم أيضاً أن المادة 10 من قانون التعليم لم تُعتمَد إلا في حزيران/ يونيه 2006 أي في أثناء فترة تعليمه الممتدة من عام 2001 إلى عام 2006، ومن ثم فإن قواعد التعيين الإجباري للأخصائيين المبتدئين الذين دُفِعت نفقات تعليمهم من ميزانية الدولة هي قواعد لم تكن موجودة، لكن المحاكم طبّقتها بأثر رجعي في انتهاك لحقوقه بموجب الفقرة 1 من المادة 14 من العهد.

Article 3 of the Law on Education of the Lao PDR (2000) provides, " All Lao citizens, irrespective of ethnicity, race, sex, and social status, have the rights to education " Article 5 also stipulates, " In developing education, the State pays attention to ethnic groups in the remote areas, women, disadvantaged and talented people " .
وتنص المادة 3 من قانون التعليم (2000) في جمهورية لاو على ما يلي: " لجميع مواطني لاو الحق في التعليم بصرف النظر عن الانتماء الإثني، والعنصر، والجنس، والوضع الاجتماعي " . وتقول المادة 5 أيضاً " عند تطوير التعليم، توجّه الدولة الاهتمام إلى الأقليات الإثنية في المناطق النائية، والنساء، والأشخاص المحرومين والموهوبين " .

However, SC-R stated that the education system was severely underfinanced, and that the implementation of the Law on Education was hampered by the Government's decision to postpone until 2014 the application of the article guaranteeing that education should receive 6% of the GDP.
بيد أن منظمة إنقاذ الطفولة - فرع رومانيا أفادت بأن نظام التعليم يعاني نقصاً شديداً في التمويل، وأن تنفيذ القانون المتعلق بالتعليم قد تعرقل بسبب قرار الحكومة أن تؤجل حتى عام 2014 تطبيق المادة التي تكفل أن التعليم ينبغي أن يحصل على 6 في المائة من الناتج المحلي الإجمالي.

148. Article 42 of the Law on Education states that " building and construction, technical tools and equipment of educational institutions shall meet specifics of work of teachers, staff, learners as well as special needs of learners with disabilities, hygiene and safety requirements " , and article 34 declares that the state shall provide learners with disabilities with learning conditions and opportunities.
148- تنص المادة 42 من القانون المتعلق بالتعليم على أن " المنشآت والمباني والأدوات والمعدات التقنية للمؤسسات التربوية ينبغي أن تفي بالاحتياجات النوعية لعمل المدرسين والموظفين والمتعلمين فضلاً عن الاحتياجات الخاصة للمتعلمين ذوي الإعاقة، وبمتطلبات النظافة والسلامة " ، وتنص المادة 34 على أنه يتعين على الدولة أن توفر للمتعلمين ذوي الإعاقة الظروف والفرص التعليمية اللازمة.
