9. The presumption in favour of the maintenance of reservations formulated by the predecessor State had already been proposed by Professor D.P. O'Connell, Rapporteur of the International Law Association on the subject of " the Succession of New States to the Treaties and Certain Other Obligations of their Predecessors " .

A majority of the members of the International Law Commission shared the view of the two Special Rapporteurs, and the commentary to article 19 as finally adopted by the Commission contains the following arguments supporting the presumption in favour of the maintenance of reservations formulated by the predecessor State:

The amendment was rejected, however, by 26 votes to 14, with 41 abstentions, and the presumption in favour of the maintenance of reservations was retained in the final text of article 20 as adopted at the Vienna Conference.

85. In cases involving the unification of States, an exception to the presumption in favour of the maintenance of reservations as established in draft guideline 5.2 nevertheless was needed to address cases in which on the date of the succession one of the predecessor States was a party to the treaty while another was a contracting State but not a party to the treaty.

While this provision establishes a general presumption in favour of the maintenance of reservations, there are nonetheless exceptions to this presumption in certain cases involving the uniting of two or more States; these are dealt with in draft guideline 5.3, to which reference is made in draft guideline 5.2, paragraph 1.

(6) While this provision establishes a general presumption in favour of the maintenance of reservations, there are nonetheless exceptions to this presumption in certain cases involving the uniting of two or more States; these are covered by guideline 5.1.3, which is referred to in paragraph 1 of the present guideline.

The second Special Rapporteur on the subject, Sir Francis Vallat, also supported the presumption in favour of the maintenance of reservations formulated by the predecessor State, despite the contrary view of a number of Governments, which had recommended the reversal of this presumption.

O'Connell, Rapporteur of the International Law Association on the subject of " the Succession of New States to the Treaties and Certain Other Obligations of their Predecessors " , one year before Sir Humphrey Waldock endorsed the concept.

A distinction should thus be made between the presumption in favour of the maintenance of reservations (a principle established, for newly independent States, by article 20, paragraph 1, of the 1978 Convention) and the question of whether the power to formulate new reservations, recognized in paragraph 2 in the case of newly independent States, can be extended to cases involving the uniting or separation of States.
