The Constitutional Court delivered a ruling on 30 August 2011 that the application of the penal provision of the Military Service Act against conscientious objectors does not infringe the freedom of conscience guaranteed by the Constitution.
وقد حكمت المحكمة الدستورية في 30 آب/أغسطس 2011 بأن تطبيق الحكم الجنائي المنصوص عليه في قانون الخدمة العسكرية ضد المستنكفين ضميرياً لا يتعدى على حرية الوجدان التي يكفلها الدستور(29).

They were both arrested and charged in separate proceedings under article 88 (section 1) of the Military Service Act.

Article 40 of the Military Service Act provides that any person who fails to present himself for the military service medical examination to determine his physical fitness and ascertain whether he is suffering from any contagious disease or disability that would preclude his enlistment for military service is liable to a fine ranging from 30 to 100 dinars.
وتنص المادة 40 من قانون الخدمة العسكرية على أن أي شخص يتخلف عن الحضور لإجراء الفحص المطلوب للخدمة العسكرية لإثبات صلاحيته من الناحية الصحية ومعرفة ما إذا كان مصابا بمرض معد أو عاهة جسمانية تمنعه من الالتحاق بالخدمة العسكرية، يدفع غرامة لا تقل عن 30 دينارا ولا تزيد على 100 دينار.

Section 1 of the Military Service Act reads: " ... every man of Turkish nationality shall be obliged to perform military service. "
وينص القسم 1 من قانون الخدمة العسكرية على أنه " يتعيّن على كل رجل تركي الجنسية أن يؤدي الخدمة العسكرية " .

(b) The amendment made in December 2004 to article 14, paragraph 1, of the Military Service Act which raised the minimum age for voluntary enlistment for active service in the armed forces from 17 to 18;

2.2 In its ruling, the Constitutional Court rejected a constitutional challenge to article 88 of the Military Service Act on the grounds of incompatibility with the protection of freedom of conscience protected under the Korean Constitution.

The Committee is also concerned that, according to article 25 of the Military Service Act, early enlistment is allowed for 16- and 17-year-old children who wish to leave the country at the time when they would be required by law to undertake military service, and for " those who are obliged to request early enlistment because of their studies " .
وتشعر اللجنة بالقلق أيضاً لأن المادة 25 من قانون الخدمة العسكرية تنص على جواز التجنيد المبكر في سن السادسة عشرة والسابعة عشرة بالنسبة للأطفال الذي يرغبون في مغادرة البلد عندما يحين موعد تأديتهم للخدمة العسكرية بموجب القانون، والأطفال الملزمين بطلب التجنيد المبكر لإتمام دراستهم.

20. The Committee recommends that the State party revoke article 25 of the Military Service Act, end the practice of early enlistment for 16- and 17-year-old children, and raise the minimum age for voluntary recruitment to 18 years, without exceptions.
20- توصي اللجنة الدولة الطرف بإلغاء المادة 25 من قانون الخدمة العسكرية ووضع حد لممارسة التجنيد المبكر للأطفال في سن السادسة عشرة والسابعة عشرة ورفع الحد الأدنى لسن تجنيد المتطوعين إلى ثمانية عشر عاماً دون استثناء.
