It was explained that subparagraph 10.3.2 was potentially the most controversial aspect of this provision, since it dealt with the case of the negotiable transport document.

(i) Without prejudice to the provisions of article 10.1 the holder of a negotiable transport document is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location mentioned in article 4.1.3 to such holder upon surrender of the negotiable transport document.

It was observed that the scheme set out in subparagraphs (d), (e), (f) and (g) of draft article 49 was intended to address the current problem of delivery of the goods without presentation of the negotiable transport document or electronic transport record.
52- لوحظ أن المخطط المبيّن في الفقرات الفرعية (د) و(ﻫ) و(و) و(ز) من مشروع المادة 49 يُقصد به تناول المشكلة الراهنة فيما يتعلق بتسليم البضاعة بدون إبراز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول.

(d) To delete all references in the draft convention to the use of multiple originals of the negotiable transport document.
(د) حذف جميع الإشارات الواردة في مشروع الاتفاقية إلى استخدام نسخ أصلية متعددة لمستند النقل القابل للتداول.

It was noted that there was no sanction in the draft convention for a failure to include the other contract particulars required pursuant to draft article 37, and that the proposed inclusion in draft article 40 of such a provision in the case of a failure to provide the number of originals of the negotiable transport document would be unique in that regard.

Other concerns expressed with respect to subparagraph 10.3.2 (d) were that the rights of the holder who was in possession of the negotiable transport document after delivery had been effected should be more precisely established.

However, the Working Group strongly supported the third option set out in paragraph 48 above, to include the text proposed with respect to subparagraph (c), but to reverse the decision taken at its nineteenth session to include a sanction for failing to include the number of multiple originals of the negotiable transport document in the contract particulars.

There was some support for the view that the establishment of such a system undermined the traditional bill of lading system by institutionalizing the undesirable practice of delivery without presentation of the negotiable transport document or electronic transport record.
53- وكان هناك قدر من التأييد للرأي الذي مفاده أن إنشاء نظام من هذا القبيل يقوِّض نظام سندات الشحن التقليدي بإضفاء طابع مؤسسي على الممارسة غير المرغوبة المتمثلة في التسليم بدون إبراز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول.

236. It was indicated that draft paragraph 49 (b) dealt with cases in which the cargo had arrived at destination but the holder of the negotiable transport document or negotiable electronic transport record did not claim delivery of it.
236- أُفيد بأن مشروع الفقرة 49 (ب) يتناول الحالات التي تكون فيها البضاعة المشحونة قد وصلت إلى المقصد لكن حائز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول لم يطالب بتسلّمها.

(i) Upon surrender of the negotiable transport document and, if the holder is one of the persons referred to in article 1, subparagraph 10 (a) (i), upon the holder properly identifying itself; or

It was generally recognized that the system established by subparagraphs (d), (e), (f) and (g) of draft article 49 intended to protect in such cases both the carrier and the third party acquirer of the negotiable transport document or electronic transport record.
54- وكان هناك تسليم عموما بأن النظام الذي ترسيه الفقرات الفرعية (د) و(ﻫ) و(و) و(ز) من مشروع المادة 49 يُقصَد به أن يحمي في تلك الحالات كلا من الناقل والطرف الثالث الذي يحصل على مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول.

As a consequence, it was suggested that subparagraphs (d), (e), (f) and (g) of draft article 49 should be deleted in their entirety, and that the matter of delivery of the goods without presentation of the negotiable transport document or electronic transport record should be left entirely to national law (see A/CN.9/WG.III/WP.99).
56- ونتيجة لذلك، اقتُرح حذف الفقرات الفرعية (د) و(ﻫ) و(و) و(ز) برمتها من مشروع المادة 49 وترك كامل مسألة تسليم البضاعة بدون إبراز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول للقانون الوطني لكي يبُتَّ فيها (انظر الوثيقة A/CN.9/WG.III/WP.99).
