50. The Committee recommends that the State party review the discriminatory provisions of the Personal Status Act and, in particular:

Article 306 of the Personal Status Act applied to all citizens, with the exception of the Druze and Christian communities, which had their own private courts that took priority on all matters affecting their congregations.

4. The consent of the legal guardian is necessary for the conclusion of the contract, having regard to the provisions of articles 6 and 12 of the Personal Status Act.

Article 164 of the Personal Status Act stipulates that: " A minor shall not be entitled to receive his property before reaching the age of majority " .

Her third question related to article 40 of the Personal Status Act, which dealt with intimate details of marriage and, in particular, obliged a wife to allow her husband to have sexual intercourse with her.
6- أما سؤالها الثالث فيتصل بالمادة 40 من قانون الأحوال الشخصية التي تتناول التفاصيل الدقيقة للزواج ويلزم الزوجة على وجه الخصوص بالسماح لزوجها بمعاشرتها جنسياً.

Article 159 of the Personal Status Act provides: All persons are legally competent to conclude contracts unless such competence is stripped from them or limited by law, and article 174 clarifies that the impediments to legal competence are insanity, feeble-mindedness and terminal illness.
وقد نصت المادة 159 من قانون الأحوال الشخصية على " أن كل شخص أهل للتعاقد ما لم تسلب أهليته أو يحد منها بحكم القانون " ، وأوضحت المادة 174 أن عوارض الأهلية هي الجنون والسفه، ومرض الموت.

Article 55 of the Personal Status Act specifies the rights of the woman with respect to her husband: not to prevent her from completing her education; not to prevent her from visiting her ascendants, descendants and siblings; not to interfere with her personal property; and not to harm her either materially or morally.
وقد نصت المادة 55 من قانون الأحوال الشخصية على حقوق الزوجة على زوجها والمتمثلة في النفقة، وعدم منعها في إكمال تعليمها، وعدم منعها من زيارة أصولها وفروعها وأخواتها، وعدم التعرض لأموالها الخاصة، عدم الإضرار بها ماديا أو معنويا.

Despite the fact that a woman is not obliged to provide for children, something that actually constitutes a privilege in the woman's favour, she has reciprocal rights with her husband with regard to their care, education and proper upbringing pursuant to article 54 of the Personal Status Act.

Where a woman has been coerced into consenting to marriage with the man who has asked for her hand, the contract is not valid from a legal standpoint. This is explicitly stated in article 10 of the Personal Status Act.
388- وإذا وقع العقد في ظل إكراه المرأة على الزواج بمن تقدم لها فلا اعتبار لذلك العقد من الناحية القانونية وهو ما نصت عليه المادة 10 من قانون الأحوال الشخصية.

63. Articles 136, 149 and 158 of the Personal Status Act affirm that a mother has an obligation to breastfeed her child or, if this proves impossible, to have the child breastfed by another women in return for remuneration.
63- وتؤكد المواد 136، و149، و158 من قانون الأحوال الشخصية أن على الأم إرضاع طفلها. وإذا تعذر ذلك فانه يتم إرضاعه من أخرى بأجر.

127. Article 141 of the Personal Status Act provides that the mother has a greater right to custody of her children after divorce or after the death of her spouse.
١٢٧- وتؤكد عليه المادة ١٤١ من قانون الأحوال الشخصية على أن الأم هي الأولى بحضانة أولادها سواء كان ذلك بعد الطلاق أو بعد وفاة الزوج.

A number of articles of the Personal Status Act have been amended as well. This Act will be discussed in paragraph 93 below.

Articles 128, 129, 131, 131 and 132 of the Personal Status Act are concerned with the protection of children and their right to life, survival and development.
