121- وإن من بين الضمانات الأساسية الواقية من سوء المعاملة ما يتمثل في حق المحتجز أو المحامي في تقديم طلب أو شكوى بشأن معاملته أثناء احتجازه إلى السلطات المسؤولة عن إدارة مكان الاحتجاز والى السلطات الأعلى، وعند الاقتضاء إلى السلطات المناسبة المناطة بها صلاحيات المراجعة أو الإنصاف().

157. The right of any detainee to make a request or complaint regarding their treatment, in particular in the case of torture or ill-treatment, to the authorities responsible for the administration of the place of detention, to higher authorities and, when necessary, to appropriate authorities vested with reviewing or remedial powers, constitutes a basic safeguard against torture.
157- إن حق أي محتجز في تقديم طلب أو شكوى بشأن المعاملة التي يلقاها، وبخاصة في حالات التعذيب أو إساءة المعاملة، إلى السلطات المسؤولة عن إدارة مكان الاحتجاز وإلى السلطات الأعلى، وعند الضرورة، إلى السلطات المخولة صلاحيات المراجعة أو الإنصاف، يشكل ضمانة أساسية ضد التعذيب().

100. The SPT notes that the right of any detainee to submit a petition or appeal concerning their treatment, in particular in the case of torture or ill-treatment, to the authorities responsible for the administration of the place of detention, to higher authority and, when necessary, to appropriate watchdog or law enforcement authorities, constitutes a basic safeguard against torture.

96. One of the basic safeguards against ill-treatment is the right of a detained person or his representative to make a request or complaint regarding his treatment, in particular in the event of torture or other cruel, inhuman or degrading treatment, to the authorities responsible for the administration of the place of detention and to higher authorities and, when necessary, to appropriate authorities vested with powers of review or redress.
96- وإحدى الضمانات الأساسية ضد إساءة المعاملة هي حق الشخص المحتجز أو من يمثله في تقديم طلب أو شكوى بخصوص معاملته، وبصفة خاصة في حالة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، إلى السلطات المسؤولة عن إدارة مكان الاحتجاز أو إلى السلطات الأعلى وكذلك، عند الاقتضاء، إلى السلطات المعنية المخولة صلاحيات المراجعة أو الإنصاف().

A prisoner has the right to receive independent inspections or supervision appointed by and responsible to a competent authority distinct from the authority in charge of the administration of the place of detention or imprisonment and to communicate freely and in full confidentiality with persons who visit the places of detention or imprisonment, subject to reasonable conditions to ensure security and good order in such places.
