On 5 December 2000, the Special Rapporteur transmitted an urgent appeal concerning the decision of the Government to close the weekly newspapers Le Journal, Assahifa and Demain on the basis of article 77 of the Press Code.

However, according to information sent to the Special Rapporteur, the provision on registration of copyright in chapter I of the Press Code is usually used to block all undesirable publications.

In particular, there should be a review and, where appropriate, amendment of those provisions of the Press Code which unduly protect government policy and officials from criticism.
وينبغي بوجه خاص استعراض أحكام قانون الصحافة التي تحمي بشكل لا موجب له سياسة الحكومة والمسؤولين الحكومين من النقد، وتعديل تلك اﻷحكام عندما يقتضي اﻷمر.

The legislation protects the child from any interference with or attacks on his or her personal circumstances, family, honour, or reputation. Consequently, article 44 of the Press Code protects the child from insult or injury, as it stipulates that:
221- ويحمي المشرّع المغربي الطفل من أي مساس غير قانوني بحالته الخاصة، وأسرته، وشرفه وسمعته، وبالتالي، تحمي مقتضيات المادة 44 من قانون الصحافة الطفل من القذف والسب، حيث تنص على أنه:

The Prime Minister or an agency delegated to act on his behalf may prohibit the display of such material that may be immoral or harmful to the youth in public areas or in any open area, and the broadcast of such material in any manner in public areas (article 66 of the Press Code).
214- ويجوز للوزير الأول أو للسلطة المنتدبة من طرفه منع عرض كل نشرة متنافية مع الأخلاق والآداب أو مضرة بالشباب، وذلك في الطرق العمومية أو الأماكن المفتوحة في وجه العموم، وكذا إذاعتها بأي طريقة ما في الطريق العمومية، حسب مقتضيات المادة 66 من قانون الصحافة.

Article 51 of the Press Code should be brought into line with article 19 of the Covenant, so as to ensure a fair balance between protection of a person's reputation and freedom of expression.
وينبغي مواءمة المادة 51 من قانون الصحافة مع المادة 19 من العهد سعياً إلى ضمان التوازن العادل بين حماية سمعة الأفراد وحرية التعبير(106).

An insult in public is punishable by either a term in prison of six days to two months or a fine of 50 to 50,000 dirhams, or both. An insult that is not in public is also punishable by a fine of 200 to 240 dirhams (paragraphs 2 and 3 of section 48 of the Press Code).
كما يعاقب بحبس تتراوح مدته بين ستة أيام وشهرين وبغرامة يتراوح قدرها بين 50 و000 50 درهم أو بإحدى هاتين العقوبتين فقط عن السب العلني، كما يعاقب السب غير العلني بغرامة تتراوح بين 200 و240 درهم (الفقرتان 2 و3 من الفصل 48 من قانون الصحافة).

107. Article 39 bis of the Press Code, as amended on 3 October 2002, is applicable in this context. It condemns and prohibits racial discrimination in the mass media, public discourse, during public assemblies or in public places. Such acts are punishable with a prison term of between one month and one year and a fine of between 3,000 and 30,000 dirhams.
107- ويندرج في هذا الإطار ما نص عليه الفصل 39 مكرر من قانون الصحافة المعدل بتاريخ 3 تشرين الأول/أكتوبر 2002 الذي شجب ومنع كل تحريض على التمييز العنصري يتم بإحدى الوسائل العلنية أو الخطب أو أثناء التجمعات العمومية أو في الأماكن العمومية، وعاقب هذه الأفعال بعقوبة حبسية تتراوح مدتها مابين شهر وسنة وبغرامة مالية تتراوح ما بين 000 3 درهم و000.30 30 درهم.

109. The Moroccan judiciary has dealt rigorously and stringently with such cases of incitement to discrimination, as demonstrated by the judgements handed down. By way of example, mention may be made of the judgement delivered by the Ouarzazate court of first instance on 12 January 2007 in judicial proceedings against a person for the offence of incitement to discrimination under article 39 bis of the Press Code.
109- ولقد تعامل القضاء المغربي من جهته بحزم وصرامة مع هذه الدعوات التحريضية على التمييز، وهو ما يتضح من خلال الأحكام الصادرة في الموضوع ونسوق كمثال عليها الحكم الصادر عن المحكمة الابتدائية بورزازات بتاريخ 12 كانون الثاني/يناير 2007 حيث تمت متابعة أحد الأشخاص بجنحة التحريض على التمييز طبقاً للفصل 39 مكرر من قانون الصحافة.

Article 51 of the Press Code should be brought in line with article 19 of the Covenant, so as to ensure a fair balance between protection of a person's reputation and freedom of expression.
وينبغي أن يكون الفصل 51 من " مجلة الصحافة " متوائماً مع المادة 19 من العهد مع تحقيق توازن سليم بين حماية سمعة الأشخاص وحرية التعبير.

16. Under the provisions of article 49 of the Press Code, promulgated by the Act of 28 April 1975, the publication, dissemination or reproduction of false information liable to disturb public order is punishable by a fine and prison sentence of between two months and three years.
16- تنص أحكام المادة 49 من مجلة الصحافة التي صدرت بالقانون المؤرخ في 28 نيسان/أبريل 1975 على أن إصدار أو نشر أو إعادة نشر أنباء مزيفة يمكن أن تزعزع النظام العام يستوجب العقاب بغرامة وبحكم بالسجن تتراوح مدته بين شهرين وثلاث سنوات.

35. The Special Rapporteur also noted with concern that chapter IV of the Press Code, on " Offences committed by means of the press or any other publication medium " , was imprecise in its definition of the elements that constituted these offences, thus opening the way for broad or even wrongful interpretations.
35- وبالإضافة إلى ذلك، لاحظ المقرر الخاص مع القلق أن الفصل الرابع من مجلة الصحافة المخصص " للجرائم والجنح التي ترتكب عن طريق الصحافة أو بأية وسيلة أخرى من وسائل النشر " يتسم بعدم دقة الأركان المؤسسة لهذه الجنح، مما يفتح الباب أمام التفسيرات العامة، بل المغايرة للقصد.

(a) In accordance with the recommendations formulated in November 1994 by the United Nations Human Rights Committee, the Special Rapporteur urges the Government to amend the defamation provisions of the Press Code so as to make this offence no longer punishable by imprisonment and to redefine the concept of a press offence;
(أ) وفقا للتوصيات الصادرة في تشرين الثاني/نوفمبر 1994 عن اللجنة المعنية بحقوق الإنسان التابعة للأمم المتحدة، يحث المقرر الخاص الحكومة التونسية على أن تعدل الأحكام المتعلقة بالقذف من مجلة الصحافة بحيث لا يعاقب على ارتكاب هذه الجنحة بالسجن وأن تعيد الحكومة التونسية تعريف مفهوم جنحة الصحافة.
