The discussion both in the Commission and in the Sixth Committee leads to the conclusion that, even if the primary context for the application of the principle of effective nationality is the law of diplomatic protection, the underlying notion of genuine link also has some role to play in the determination of the principles applicable to the withdrawal or granting of nationality in situations of State succession.
٣٣ - وتفضي المناقشة سواء في لجنة القانون الدولي أو في اللجنة السادسة الى استنتاج أنه حتى في الحالة التي يكون فيها قانون الحماية الدبلوماسية هو اﻹطار اﻷولي لتطبيق مبدأ الجنسية الفعلية، فإن للفكرة التي يستند إليها والمتمثلة في فكرة الرابطة الحقيقية دورا ما أيضا في تحديد المبادئ المطبقة على سحب الجنسية أو منحها في حالات خلافة الدول.

14. In the light of the foregoing, the Working Group is of the opinion that the deprivation of liberty of Tang Xi Tao, Han Yuejuan, Zhao Ming and Yang Chanrong is arbitrary, as being contrary to articles 10, 11, 18, 19 and 20 of the Universal Declaration of Human Rights, and falls within category II of the principles applicable to the consideration of cases submitted to the Working Group.

8. It follows from the above considerations that the detention of all the above—mentioned persons is arbitrary as it cannot be linked to any legal basis (category I of the principles applicable in the consideration of the cases submitted to the Working Group).
٨- يُستدل مما تقدم أن احتجاز جميع اﻷشخاص المذكورة أسماؤهم أعلاه هو احتجاز تعسفي، حيث إنه يتعذر إسناده إلى أي أساس قانوني )الفئة اﻷولى من المبادئ المنطبقة عند النظر في القضايا المعروضة على الفريق العامل(.

(a) Considers that the detention of Xue Deyun (alias Ma Zhe) is arbitrary as it contravenes article 19 of the Universal Declaration of Human Rights and falls within category II of the principles applicable in the consideration of the cases submitted to the Working Group;
