In circumstances where the issue at hand is determined to be due to circumstances beyond the control of the requested State Party, the Meeting of States Parties may recommend appropriate measures, including the use of cooperative measures referred to in Article 6 of this Convention.

إذا كان قانون الدولة الطرف متلقية الطلب لا ينص على العقوبة المنطبقة في قانون الدولة الطرف الطالبة بسبب الوقائع التي طُلب لأجلها تسليم الشخص المعني، يُستعاض عن هذه العقوبة، بناء على اتفاق بين الدولتين الطرفين، بالعقوبة المنطبقة على نفس الجريمة في قانون الدولة الطرف متلقية الطلب.

2. A request for the consent of the requested State Party under the present article shall be accompanied by the documents mentioned in article 38 of the present Convention and a legal record of any statement made by the extradited person with respect to the offence.
2 - يشفع طلب الحصول على موافقة الدولة الطرف متلقية الطلب بموجب هذه المادة بالوثائق المذكورة في المـادة 38 من هذه الاتفاقية وبمحضر قانوني لأي أقوال أدلى بها الشخص الذي تم تسليمه بسبب الجريمة.

5. Extradition shall be subject to the conditions provided for by the law of the requested State Party or by applicable extradition treaties, including the grounds upon which the requested Party may refuse extradition.
٥- يخضع تسليم المجرمين، بما في ذلك اﻷسباب التي يجوز أن يستند إليها الطرف متلقي الطلب في رفض التسليم، للشروط التي ينص عليها قانون الدولة الطرف متلقية الطلب أو معاهدات تسليم المجرمين الواجبة التطبيق.

30. The travaux préparatoires should indicate that one example of implementation of this paragraph would be speedy and simplified procedures of extradition, subject to the domestic law of the requested State Party for the surrender of persons sought for the purpose of extradition, subject to the agreement of the requested State Party and the consent of the person in question.
30- ينبغي أن يذكر في " الأعمال التحضيرية " أن أحد أمثلة تنفيذ هذه الفقرة هو توفير اجراءات تسليم سريعة ومبسطة، رهنا بأحكام القانون الداخلي للدولة الطرف متلقية الطلب فيما يتعلق بتسليم الأشخاص المطلوب تسليمهم، ورهنا بموافقة الدولة الطرف متلقية الطلب وقبول الشخص المعني.

19. The requesting State Party shall not transmit or use information or evidence furnished by the requested State Party for investigations, prosecutions or judicial proceedings other than those stated in the request without the prior consent of the requested State Party.
19- لا يجوز للدولة الطرف الطالبة أن تنقل المعلومات أو الأدلة التي زودتها بها الدولة الطرف متلقية الطلب، أو أن تستخدمها في تحقيقات أو ملاحقات أو إجراءات قضائية غير تلك المذكورة في الطلب، دون موافقة مسبقة من الدولة الطرف متلقية الطلب.

5. Extradition shall be subject to the conditions provided for by the law of the requested State Party or by applicable extradition treaties, including the grounds upon which the requested Party may refuse extradition.
٥ - يخضع تسليم المجرمين للشروط التي ينص عليها قانون الدولة الطرف متلقية الطلب أو معاهدات تسليم المجرمين الواجبة التطبيق ، بما في ذلك اﻷسباب التي يجوز أن يستند اليها الطرف متلقي الطلب في رفض التسليم .

Where the law of the requested State Party so requires, the accused person shall be entitled to challenge the request for arrest and surrender in the court of the requested State Party on the ground that the evidence submitted in support of the request would not be sufficient to commit him to trial for such an offence in a court of the requested State.
يحق للمتهم، حيثما يقتضي ذلك قانون الدولة الطرف المطلوب منها التسليم، أن يطعن في طلب القبض والتسليم لدى محكمة الدولة الطرف المطلوب منها التسليم استنادا الى عدم كفاية اﻷدلة المقدمة دعما لطلب التسليم لتقديمه للمحاكمة على هذا الجرم في محكمة تابعة للدولة المطلوب منها التسليم.

2. Such mutual legal assistance shall be subject to the conditions provided for by the domestic law of the requested State Party or by applicable treaties on mutual legal assistance, including, in particular, the conditions in relation to the grounds upon which the requested State Party may refuse to grant mutual legal assistance or may make it subject to conditions.
2 - تخضع هذه المساعدة القضائية للشروط المحددة في القانون الداخلي للدولة الطرف التي يطلب منها التسليم أو في المعاهدات السارية المتعلقة بالمساعدة القضائية، بما في ذلك، بوجه خاص، الأسباب التي تجيز للدولة الطرف التي يُطلَب منها التسليم رفض تقديم المساعدة القضائية أو إخضاعه لشروط.

If the request cannot be executed without breaching the requested confidentiality, the central authority of the requested State Party shall so inform the requesting State Party, which shall then determine whether the request should nevertheless be executed.
وإذا استحال تنفيذ الطلب دون انتهاك السرية المطلوبة، تقوم السلطة المركزية للدولة الطرف الموجه إليها الطلب بإشعار الدولة الطرف الطالبة بالأمر، التي تقرر عندئذ إذا كان من المناسب تنفيذ الطلب على الرغم من ذلك.
