266. The Secretary-General recommends that the General Assembly amend article 11.3 of the statute of the United Nations Dispute Tribunal to clarify that the interlocutory orders issued by the Tribunal may be subject to appeal.
266 - ويوصي الأمين العام بأن تقوم الجمعية العامة بتعديل المادة 11-3 من النظام الأساسي لمحكمة الأمم المتحدة للمنازعات بحيث توضح أنه يجوز استئناف الأوامر العارضة التي تصدرها المحكمة.

157. Pursuant to article 10 (8) of the statute of the United Nations Dispute Tribunal, the Dispute Tribunal may refer appropriate cases to the Secretary-General or the executive heads of separately administered United Nations funds and programmes for possible action to enforce accountability.

In paragraph 29 of the resolution, the Assembly, noting article 7, paragraph 1, of the statute of the United Nations Dispute Tribunal and article 6, paragraph 1, of the statute of the United Nations Appeals Tribunal, requested the Secretary-General to submit, for its approval, the rules of procedure of the Tribunals as soon as possible but no later than at its sixty-fourth session.

In this connection, the Committee recalls that article 2.10 of the statute of the United Nations Appeals Tribunal, as approved by the General Assembly in its resolution 63/253, provides for the conclusion of a special agreement with the Secretary-General if the organization concerned utilizes a neutral first instance process.

10. The amendment arose from the decision of the General Assembly to amend article 7, paragraph 1 (c), of the statute of the United Nations Appeals Tribunal, which extended the deadline for filing appeals of Dispute Tribunal judgements from 45 days to 60 days (see resolution 66/237, para. 31).
10- وقد نشأ هذا التعديل من قرار الجمعية العامة بشأن تعديل الفقرة 1 (ج) من المادة 7 من النظام الأساسي لمحكمة الأمم المتحدة للاستئناف، الذي مدّد المهلة المحددة لرفع دعاوى استئناف الأحكام الصادرة عن محكمة المنازعات من 45 يوما إلى 60 يوما (انظر القرار 66/237، الفقرة 31).

255. The Secretary-General recommends that the General Assembly amend article 7.2 (h) of the statute of the United Nations Dispute Tribunal and article 6 of the statute of the United Nations Appeals Tribunal to provide for a mechanism in their rules of procedure to dismiss expeditiously cases that are manifestly inadmissible or manifestly lacking any foundation in law.
255 - ويوصي الأمين العام بأن تقوم الجمعية العامة بتعديل المادة 7-2(ح) من النظام الأساسي لمحكمة الأمم المتحدة للمنازعات والمادة 6 من النظام الأساسي لمحكمة الأمم المتحدة للاستئناف بحيث تنصّان على وجود آلية في لائحتيهما لسرعة رد الدعاوى التي يكون جليا أنها غير مقبولة أو تفتقر إلى أساس قانوني.

259. The Secretary-General recommends that the General Assembly revise article 7.2 (e) of the statute of the United Nations Dispute Tribunal to provide that audio recordings of oral hearings before the Tribunal are to be maintained and made available to the parties upon request.
259 - ويوصي الأمين العام بأن تقوم الجمعية العامة بتنقيح المادة 7-2(هـ) من النظام الأساسي لمحكمة الأمم المتحدة للمنازعات بحيث تنصّ على تعهد التسجيلات السمعية لجلسات الاستماع الشفوية أمام المحكمة وإتاحتها للطرفين لدى طلبها.

269. The Secretary-General recommends that the General Assembly amend article 7.1 (c) of the statute of the United Nations Appeals Tribunal to extend the deadline for filing appeals of United Nations Dispute Tribunal judgements from 45 days to 60 days and to establish a 30-day deadline for filing appeals of interlocutory orders.
269 - ويوصي الأمين العام بأن تقوم الجمعية العامة بتعديل المادة 7-1(ج) من النظام الأساسي لمحكمة الأمم المتحدة للاستئناف، لتمديد الموعد النهائي لاستئناف الأحكام التي تصدرها الأمم المتحدة للمنازعات من 45 يوما إلى 60 يوما وتحديد مهلة 30 يوما لاستئناف الأوامر العارضة.

Judgements are issued in English and French, but, under article 11, paragraph 5, of the statute of the United Nations Dispute Tribunal and article 10, paragraph 8, of the statute of the United Nations Appeals Tribunal, an applicant shall receive a copy in the language in which the application or appeal was submitted unless he or she requests a copy in another official language of the Organization.
