1. The purpose of the article is to enable the procuring entity to reject a submission whose abnormally low price gives rise to concerns as to the ability of the supplier or contractor presenting such submission to perform the procurement contract.
1- الغرض من هذه المادة هو تمكين الجهة المشترية من رفض العرض الذي يثير سعره المنخفض انخفاضا غير عادي شواغل بشأن قدرة المورِّد أو المقاول الذي قدّمه على تنفيذ عقد الاشتراء.

1. The purpose of the article is to provide an exhaustive list of grounds for the exclusion of a supplier or contractor from the procurement proceedings for the reasons not linked to the content of a submission presented or the qualifications of the supplier or contractor.
1- الغرض من هذه المادة هو تقديم قائمة شاملة بالأسس التي يُستند إليها لاستبعاد مورِّد أو مقاول من إجراءات الاشتراء لأسباب غير متصلة بمحتوى العرض المقدَّم أو مؤهّلات المورِّد أو المقاول.

Submission which price in combination with other constituent elements of the submission is so abnormally low in relation to the subject matter of the procurement that it raises concerns with the procuring entity as to the ability of the supplier or contractor that presented it to perform the procurement contract.
هو العرض المقدَّم الذي يكون سعره، بالاقتران مع سائر العناصر المكوِّنة، منخفضاً بالقياس إلى الشيء موضوع الاشتراء انخفاضاً غير عادي بحيث يثير لدى الجهة المشترية شواغل بشأن مدى قدرة المورِّد أو المقاول الذي قدَّم ذلك العرض على تنفيذ عقد الاشتراء.

(c) Where relevant in procurement conducted in accordance with articles 47, 49 and 50 of the Model Law [**hyperlinks**], the experience, reliability and professional and managerial competence of the supplier or contractor and of the personnel to be involved in providing the subject matter of the procurement;
(ج) مدى ما يتمتع به المورِّد أو المقاول والعاملين الذين سيقومون بتوفير الشيء موضوع الاشتراء من خبرات وموثوقية ومدى كفاءتهم المهنية والإدارية، حيثما كان ذلك مهمًّا في عملية الاشتراء المضطلع بها وفقاً لأحكام المواد 47 و49 و50 من القانون النموذجي [**وَصْلات تشعُّبية**]؛

(a) The procuring entity has requested in writing from the supplier or contractor details of the submission that gives rise to concerns as to the ability of the supplier or contractor to perform the procurement contract; and

10. Upon the entry into force of the procurement contract and, if required, the provision by the supplier or contractor of a security for the performance of the contract, notice of the procurement contract shall be given promptly to other suppliers or contractors, specifying the name and address of the supplier or contractor that has entered into the contract and the contract price.
10- عندما يبدأ نفاذُ عقد الاشتراء ويقدِّم المورِّدُ أو المقاول ضمانة لتنفيذ العقد، إذا كان يُشترَط تقديمها، يُوجَّه إلى المورِّدين أو المقاولين الآخرين على وجه السرعة إشعار بإبرام عقد الاشتراء يُحدَّد فيه اسم وعنوان المورِّد أو المقاول الذي أُبرم معه العقد وسعر العقد.

4. For these reasons, the article protects suppliers and contractors against the possibility of arbitrary decisions and abusive practices by procuring entities by allowing the rejection of an abnormally low submission only when the procuring entity has taken steps to substantiate its concerns as to the ability of the supplier or contractor to perform the procurement contract.
4- ولهذه الأسباب، تحمي هذه المادة المورِّدين والمقاولين من احتمال اتخاذ الجهة المشترية قرارات اعتباطية أو اتّباعها ممارسات تعسّفية، إذ لا تسمح برفض عرض منخفض انخفاضا غير عادي إلاّ في حال اتخاذ الجهة المشترية خطوات لإثبات دواعي قلقها إزاء قدرة المورِّد أو المقاول على تنفيذ عقد الاشتراء.

(a) the qualifications, experience, reputation, reliability and professional and managerial competence of the supplier or contractor and of its personnel;
)أ( مايتمتع به المورد أو المقاول والعاملون معه من مؤهلات وخبرة وسمعة وموثوقية وكفاءة مهنية وإدارية :

(6) (a) The procuring entity shall disqualify a supplier or contractor if it finds at any time that the information submitted concerning the qualifications of the supplier or contractor was false;
)٦( )أ( تقرر الجهة المشترية حرمان المورد أو المقاول من التأهيل إذا اكتشفت في أي وقت أن المعلومات المقدمة بخصوص مؤهلات المورد أو المقاول كاذبة؛

2. In procurement by means of an auction that was not preceded by examination or evaluation of initial bids, the procuring entity shall ascertain after the auction the responsiveness of the successful bid and the qualifications of the supplier or contractor submitting it.
2- في حالة الاشتراء بالمناقصة الذي لم يَسبق فيه المناقصةَ فحصٌ للعطاءات الأوَّلية أو تقييمٌ لها، تتأكد الجهةُ المشترية، بعد المناقصة، من مدى استجابة العطاء الفائز للمتطلبات ومن مؤهلات الموَرِّد أو المقاول الذي قدَّمه.

(iii) Where the procurement is conducted in accordance with article ... [two-envelope tendering] or with chapter IV, and where relevant, the qualifications, experience, reputation, reliability and professional and managerial competence of the supplier or contractor and of the personnel to be involved in providing the services, subject to any margin of preference applied pursuant to paragraph (4) (b) of this article. "
`3` إذا جرى الاشتراء وفقا للمادة ... [تقديم العطاءات بمظروفين] أو وفقا للفصل الرابع، وعند الاقتضاء، مؤهلات المورّد أو المقاول والموظفين الذين سيشتركون في تقديم الخدمات وخبرتهم وسمعتهم وموثوقيتهم وكفاءتهم المهنية والإدارية، رهنا بـأي هامش تفضيل يُطبّق عملا بالفقرة (4) (ب) من هذه المادة. "
