59. The following are some examples of the numerous rulings of the Supreme Constitutional Court in which legislative provisions that violate the principle of equality and non—discrimination have been declared unconstitutional:
٩٥- وقد صدر في هذا الصدد العديد من أحكام المحكمة الدستورية العليا التي قضت بعدم دستورية نصوص تشريعية مخالفة لمبدأ المساواة وعدم التمييز، وسنشير لبعض منها فيما يلي:

In accordance with the ruling of the Supreme Constitutional Court, these restrictions must be based on a democratic concept consistent with the customary practice in democratic regimes.
ويتعين أن تقوم هذه القيود في إطار الالتزام بما انتهت إليه المحكمة الدستورية العليا من وجوب أن تقوم في ضوء مفهوم ديمقراطي على نسق ما يجري عليه العمل في النظم الديمقراطية.

During the discussion, the Committee welcomed the legislative measures taken by Egypt and the relevant decisions of the Supreme Constitutional Court.

The Egyptian legal system is founded on the rule of law and the independence of the judiciary. The Constitution provides for a judicial authority comprising different types of courts and for the establishment of the Supreme Constitutional Court to rule on the constitutionality of laws. Egypt's judicial system, as regulated by the Constitution, is described in some detail hereunder.

The establishment of the Supreme Constitutional Court by Act No. 12 of 2008 (promulgated on 18 June 2008) further boosted the protection provided for this principle under the Constitution, as the Constitutional Court adjudicates in disputes over the constitutionality of laws and regulations.

23. Article 142 stipulates that: " The members of the Supreme Constitutional Court shall be removable from office only in the manner provided by law " .
