243. Article 1 of the Syrian Penal Code stipulates that: " No penalty or precautionary or reform measure shall be imposed for an offence which was not legally designated as such at the time of its commission " .
243- كما نصت المادة 1 من قانون العقوبات السوري " لا تفرض عقوبة ولا تدبير احترازي أو اصلاحي من أجل جرم لم يكن القانون قد نص عليه حين اقترافه " .

Even though there has never been any discrimination in Syria, in order to preclude any manifestation thereof the legislature has designated as a punishable offence any act or written or oral communication that is intended to instigate confessional or racial bigotry or provoke conflict among the various communities and component elements of the nation (article 307 of the Syrian Penal Code).
إذ يعاقب القانون كل عمل أو كل كتابة وكل خطاب يقصد منه إثارة للنعرات الطائفية أو العنصرية أو الحض على النزاع بين الطوائف ومختلف عناصر الأمة. (المادة 307 من قانون العقوبات السوري).

6. On 9 February 2010, Ms. Ma'ruf's lawyer requested her release, and when the sentence not served was brought up, the lawyer explained that this had expired under the prescription provisions of article 162 of the Syrian Penal Code.

9. On 17 June 2007, the seven men were convicted of " taking action or making a written statement or speech which could endanger the State or harm its relationship with a foreign country, or expose it to the risk of hostile action " pursuant to article 278 of the Syrian Penal Code.
9- وفي 17 حزيران/يونيه 2007، أُدين الرجال السبعة " بالقيام بعمل أو الإدلاء ببيان مكتوب أو خطاب يمكن أن يُعرّض الدولة للخطر أو يضر بعلاقاتها ببلد أجنبي، أو يعرّضها لخطر أعمال عدائية " وفقاً للمادة 278 من قانون العقوبات السوري.

He was charged with " undermining patriotic sentiment " , " weakening national morale " , " insulting the dignity of the State " and " inciting sectarian hatred " under articles 285, 286, 287, 307 and 308 of the Syrian Penal Code.

7. According to the source, Haytham al-Maleh was detained on 14 October 2009 on charges of " weakening nationalist sentiment " (art. 285 of the Syrian Penal Code), " conveying within Syria false news " (art. 286) and " slandering governmental body " (art. 376).

On 5 January 1995, Ms. Ma'ruf was sentenced by the Supreme State Security Court to six years in prison with hard labour for " membership in a secret organization which aims to change the economic and social status of the state " (article 306 of the Syrian Penal Code).
وفي 5 كانون الثاني/يناير 1995 حكمت محكمة أمن الدولة العليا على السيدة معروف بالسجن لمدة ست سنوات مع الأشغال الشاقة بتهمة عضويتها في منظمة سرية ترمي إلى " تغيير كيان الدولة الاقتصادي والاجتماعي " (المادة 306 من قانون العقوبات السوري).
