The Working Group took note of the following comments made by the Secretariat on the drafting of certain provisions of the transparency convention:

The deliberations and decisions of the Working Group with respect to this item are reflected in chapter IV. The Secretariat was requested to prepare a revised draft of the transparency convention, based on the deliberations and decisions of the Working Group.
وتَرِدُ في الفصل الرابع مداولاتُ الفريق العامل وقراراتُه بشأن هذا البند. وقد طُلب إلى الأمانة أن تعد صيغة منقَّحة من مشروع اتفاقية الشفافية استناداً إلى تلك المداولات والقرارات.

First, it was intended to clarify matters of drafting, and it was said that defining terms as the draft proposal did, would eliminate undue repetition in the text of the transparency convention.
فهو يهدف، أولاً، إلى توضيح أمور تتعلق بالصياغة وقيل إنَّ تعريف المصطلحات على النحو الوارد في مشروع المُقترح سيُلغي تكراراً لا ضرورة له في نص اتفاقية الشفافية.

It was said in support of the inclusion of that word that its purpose was avoid a broader application of the transparency convention than intended, as highlighted above in paragraph 45.
وقيل تأييداً لإدراج هذه الكلمة إنَّ الغرض منها هو تفادي التوسع في تطبيق اتفاقية الشفافية عن المقصود، كما هو مبيَّن في الفقرة 45 أعلاه.

Contracting Parties that wished to apply a higher or different standard of transparency as contained in existing investment treaties would be required to reserve the application of the transparency convention in relation to those investment treaties.
وسوف يتعيَّن على الأطراف المتعاقدة التي ترغب في تطبيق معيار شفافية أعلى أو مختلف منصوص عليه في معاهدات استثمار قائمة، أن تستبعد معاهدات الاستثمار هذه من تطبيق اتفاقية الشفافية.

It was said however that in the context of the transparency convention, the intended audience were the Contracting Parties themselves, as well as disputing parties and arbitral tribunals, and that in that context the provision was unnecessary.
وقيل مع ذلك إنَّ الفئة المستهدفة في سياق اتفاقية الشفافية هي الأطراف المتعاقدة نفسها والأطراف المتنازعة وهيئات التحكيم، ولا لزوم لذلك الحكم في ذلك السياق.

After discussion, it was agreed to delete article 2, on the basis that that provision was not necessary and that moreover its content differed from Part III of the Vienna Convention, and consequently could lead to complexity in the interpretation of the transparency convention.
28- وبعد المناقشة، اتُّفق على حذف المادة 2، لأنَّ هذا الحكم ليس ضروريًّا، كما أنَّ محتواه مغاير لما ورد في الجزء الثالث من اتفاقية فيينا، ومن ثمَّ يمكن أن يفضي إلى مصاعب في تفسير اتفاقية الشفافية.

A proposal was made to delete article 9 on the basis that such a provision only related to exceptional circumstances and moreover addressed matters beyond the scope of the transparency convention.
72- قُدِّم اقتراح بأن تُحذَف المادة 9، لأنها تخص حالات استثنائية فحسب، كما أنها تتناول أموراً تتجاوز نطاق اتفاقية الشفافية.

The Working Group considered whether the outcome of the determination as to whether the transparency convention was a successive one, or an amending one, would affect the drafting of the transparency convention.
20- ونظر الفريق العامل في ما إذا كانت نتيجة البتّ فيما إذا كانت اتفاقية الشفافية اتفاقيةً تاليةً أو اتفاقيةً معدِّلةً ستؤثر على صياغة اتفاقية الشفافية.

It was said in response that the application of the transparency convention should be based on reciprocity of consent between Parties to relevant investment treaties.
27- وقيل، ردًّا على ذلك، إنه ينبغي أن يكون تطبيق اتفاقية الشفافية مستنداً إلى الموافقة المتبادلة لأطراف معاهدات الاستثمار ذات الصلة.

Concerns were expressed that providing for a temporal limitation in the scope of application of the transparency convention would create a disjunctive situation in relation to the application of the Rules on Transparency.
55- وأُثيرت شواغل مفادها أنَّ النص على قيد زمني في نطاق تطبيق اتفاقية الشفافية سيؤدي إلى حالة انقطاع فيما يتعلق بتطبيق قواعد الشفافية.

In that respect, the Secretariat was requested to draft language creating a mechanism providing for a shorter period of time if the withdrawal or modification provided for greater transparency, for consideration at the second reading of the transparency convention.
157- وفي هذا الصدد، طُلب من الأمانة أن تعد صيغة لإنشاء آلية تنص على فترة زمنية أقصر إذا كان السحب أو التعديل سيوفِّر المزيد من الشفافية، وذلك لكي يُنظر فيها خلال القراءة الثانية لاتفاقية الشفافية.

It was agreed to proceed on the basis of that proposal for the second reading of the transparency convention.
162- واتُّفق على مواصلة العمل على أساس هذا الاقتراح في القراءة الثانية لاتفاقية الشفافية.

The Working Group recalled its discussions at its fifty-ninth session (Vienna, 16-20 September 2013) at which time it completed the first reading of the transparency convention.
14- استذكر الفريق العامل ما أجراه من مناقشات أثناء دورته التاسعة والخمسين (فيينا، 16-20 أيلول/سبتمبر 2013) التي أتمَّ فيها قراءته الأولى لاتفاقية الشفافية.
