Mr. Choung Il Chee (Republic of Korea), referring to the draft guidelines on reservations to treaties, drew attention to guideline 1.3.3, which provided that a unilateral act " shall be presumed not to constitute a reservation except when it purports to exclude or modify the legal effect of certain provisions of the treaty or of the treaty as a whole " .

If, on the contrary, the effect of an " interpretative declaration " is to undermine the legal effect of one of the provisions of the treaty or of the treaty as a whole, it is not an interpretative declaration but a reservation which should be treated as such and should therefore meet the conditions for the substantive (and formal) validity of reservations.
