64. The Working Group noted that paragraph 1, which reflected the purpose of legislative recommendation 18, was based on article 26 of the UNCITRAL Model Procurement Law, and that paragraphs 2 and 3 reflected legislative recommendation 19.

61. Suggestions have been made by at least one multilateral lending institution that it might be useful to review the need and conditions of use of some of the " alternative methods of procurement " set out in chapter V of the UNCITRAL Model Procurement Law.
61- قدّمت واحدة على الأقل من مؤسسات الإقراض المتعددة الأطراف اقتراحات مؤداها أنه قد يكون من المفيد إعادة النظر في الحاجة إلى استخدام بعض " أساليب الاشتراء البديلة " الواردة في الفصل الخامس من قانون الأونسيترال النموذجي للاشتراء وشروط هذا الاستخدام.

81. As an alternative to the use of a two-envelope system, the contracting authorities may require both technical and financial proposals to be contained in one single proposal, but structure their evaluation in two stages, as in the evaluation procedure provided in article 42 of the UNCITRAL Model Procurement Law.
81- وكبديل لاستخدام نظام المظروفين، قد تطلب السلطات المتعاقدة دمج الاقتراحات التقنية والاقتراحات المالية في اقتراح واحد ولكنها تجري تقييمها على مرحلتين على غرار إجراءات التقييم التي تنص عليها المادة 42 من قانون الأونسيترال النموذجي للاشتراء.

The Working Group recalled that article 11 of the UNCITRAL Model Procurement Law required the procuring entity to maintain a record of the procurement proceedings containing certain minimum information, and provided for that information to be made accessible.
43- ذكَّر الفريق العامل بأن المادة 11 من قانون الأونسيترال النموذجي للاشتراء تقتضي من الجهة المشترية الاحتفاظ بسجل لإجراءات الاشتراء يتضمن حدّا أدنى من المعلومات، وتنص على إتاحة الاطلاع على تلك المعلومات.

Recalling its earlier decision that a procuring entity should be given the option to stipulate that tenders must be submitted electronically under article 30 of the UNCITRAL Model Procurement Law (see section 5 above), the Working Group addressed the provisions regarding the opening of tenders under article 33 of the Model Law.

As regards the acceptance of tenders and entry into force of a procurement contract, the Working Group noted that article 36 (2)(a) and (b) of the UNCITRAL Model Procurement Law provided that the solicitation documents could require the supplier or contractor whose tender had been accepted to " sign a written procurement contract " conforming to the tender.
48- لاحظ الفريق العامل، فيما يتعلق بقبول العطاءات وبدء نفاذ عقد الاشتراء، أن المادة (36) (2) (أ) و(ب) من قانون الأونسيترال النموذجي للاشتراء تنص على أنه يجوز أن تشترط وثائق التماس العطاءات على المورّد أو المقاول الذي قُبل عطاؤه " أن يوقع على عقد اشتراء كتابي " مطابق للعطاء.

In that case, chapter IV of the UNCITRAL Model Procurement Law could then be limited to the selection of intellectual services that did not lead to measurable physical outputs, such as consulting and other professional services, the specificity of which could also be recognized in article 2 ( " Definitions " ) of the UNCITRAL Model Procurement Law.
وفي هذه الحالة يمكن إذن قصر الفصل الرابع من قانون الأونسيترال النموذجي للاشتراء على انتقاء خدمات فكرية لا تفضي إلى نواتج مادية قابلة للقياس، كالخدمات الاستشارية والخدمات الفنية الأخرى، التي يمكن أيضا التعرف على خصوصيتها في المادة 2 ( " التعاريف " ) من قانون الأونسيترال النموذجي للاشتراء.

(d) The justifications for using " single-source procurement " could be narrowed in scope so as not to include extrinsic considerations such as transfer of technology, shadow-pricing or countertrade, as is currently the case under article 22, paragraph 2, of the UNCITRAL Model Procurement Law.
(د) مسوّغات استخدام " الاشتراء من مصدر واحد " يمكن تضييق نطاقها لكي لا تشمل اعتبارات خارجية كنقل التكنولوجيا أو التسعير الصوري أو التجارة المكافئة، مثلما هو الحال في الوقت الحاضر بموجب الفقرة 2 من المادة 22 من قانون الأونسيترال النموذجي للاشتراء.
