440- وللدولة الطرف أيضاً أن تضمن تحري ومقاضاة أعمال العنف الموجهة ضد الأشخاص المنتمين إلى مجموعات إثنية وعرقية ومقاضاتها بسرعة واستفاضة.

1. If the act referred to in the preceding article is committed through the use of violence against persons or through resort to mental coercion, the perpetrator shall be liable to detention for a term of up to six months in addition to the fine specified above.
1- إذا اقترف الفعل المذكور في المادة السابقة بواسطة العنف على الأشخاص أو اللجوء إلى إكراه معنوي عوقب الفاعل بالحبس ستة أشهر على الأكثر فضلاً عن الغرامة المحددة أعلاه.

A strike shall be considered unlawful only when the strikers commit acts of violence against persons or cause substantial damage to property. "
ولا يعتبر الإضراب غير مشروع إلا إذا ارتكب المضربون أعمال عنف ضد أشخاص أو تسببوا في أضرار جسيمة بالممتلكات " .

8- يؤكد أيضاً أنه ينبغي للدول أن تبذل العناية الواجبة لمنع أعمال العنف الموجهة ضد الأشخاص المنتمين إلى أقليات دينية والتحقيق في هذه الأفعال والمعاقبة عليها، أياً كان الفاعل، وأن عدم القيام بذلك يمكن أن يشكل انتهاكاً لحقوق الإنسان؛

7- يؤكد أيضاً أنه ينبغي للدول أن تبذل العناية الواجبة لمنع أعمال العنف الموجهة ضد الأشخاص المنتمين إلى أقليات دينية والتحقيق في هذه الأفعال والمعاقبة عليها، أياً كان مرتكبوها، وأن عدم القيام بذلك يمكن أن يشكل انتهاكاً لحقوق الإنسان؛

2- ويقضى بالحبس من ثلاثة أشهر إلى ثلاث سنين إذا وقع الفعل ليلاً أو بواسطة الكسر أو العنف على الأشخاص أو باستعمال السلاح أو ارتكبه عدة أشخاص مجتمعين.
